ԵՊՀ դասախոսը դատի է տվել Նիկոլ Փաշինյանին և վարչապետի աշխատակազմին

Երևանի պետական համալսարանի քաղաքական ինստիտուտների և գործընթացների ամբիոնի դոցենտ, պատմական գիտությունների թեկնածու Մենուա Սողոմոնյանը դատական հայց է ներկայացրել ընդդեմ վարչապետ Նիկոլ Փաշինյանի և վարչապետի աշխատակազմի։ Սողոմոնյանը պահանջում է մասնակի ոչ իրավաչափ ճանաչել ԵՊՀ հոգաբարձուների խորհրդի կազմը հաստատելու վարչապետի՝ օգոստոսի 7–ի որոշումը՝ խորհրդի երկու անդամի նշանակման մասով։ Խոսքը ՀՀ վարչապետի աշխատակազմի գործերի կառավարիչ Վահան Պապիկյանի և «Մետրիկա» ՍՊԸ-ի հիմնադիր Գևորգ Մուրադյանի մասին է, որոնց նշանակումն ըստ հայցվորի՝ ոչ լեգիտիմ է։

Սողոմոնյանը NEWS.am–ի հետ զրույցում ասաց, որ խորհրդի հիշյալ անդամների նշանակման հետ կապված առկա են ԵՊՀ կանոնադրության, ԵՊՀ հոգաբարձուների խորհրդի աշխատակարգի դրույթների խախտումներ։ ԵՊՀ հոգաբարձուների խորհրդի օգոստոսի 25–ի նիստում Մենուա Սողոմոնյանն առաջարկել էր Վահան Պապիկյանի և Գևորգ Մուրադյանի լիազորությունների դադարեցման հարցն ընդգրկել նիստի օրակարգում, սակայն մերժում ստացել, ինչից հետո որոշել էր դիմել վարչական դատարան։

Անդրադառնալով Վահան Պապիկյանի նշանակման լեգիտիմությանը, Սողոմոնյանը նշեց, որ վերջինս Հոգաբարձուների խորհրդի անդամ է նշանակվել հիմնադրի կողմից՝ որպես պետական պաշտոնյա։ Մինչդեռ ըստ նրա՝ վարչապետի գործերի կառավարիչը չի համարվում պետական պաշտոն զբաղեցնող անձ, այլ կարող է համարվել պետական ծառայության պաշտոն զբաղեցնող անձ (օրենքով պետական պաշտոններ զբաղեցնողների համար նախատեսված են ավելի խիստ սահմանափակումներ և կարգավորումներ)։

 

ԵՊՀ դեցենտի հիմնավորմամբ՝ ԵՊՀ կանոնադրության մեջ օգտագործված «պետական պաշտոն» հասկացությունը պետք է կիրառվեր գործող օրենսդրության նորմերի հիման վրա, այլ ոչ թե կամայականորեն։

Իսկ ինչ վերաբերվում է Գևորգ Մուրադյանին, ապա նա խորհրդի անդամ է նշանակվել ՀՀ ԿԳՄՍ նախարարի կողմից՝ որպես տնտեսության ոլորտի ճանաչված ներկայացուցիչ կամ համալսարանի հետ համագործակցող գործատու։ Սողոմոնյանի խոսքով՝ «Մետրիկա» ՍՊԸ-ն հասարակության շրջանում բոլորովին անհայտ, ոչ նշանակալի ընկերություն է և երբևէ չի համագործակցել համալսարանի հետ։

«Անգամ հարցի ձևական կողմը պահպանված չէ. ճանաչելիության ռացիոնալ չափանիշներ կան, որոնք պահպանված չեն։ Նախկինում օրինակ՝ համալսարանի խորհրդի անդամներ են եղել ՎիվաՍել-ՄՏՍ-ի գլխավոր տնօրեն Ռալֆ Յիրիկյանը կամ «Սինոփսիս» ընկերությունը տնօրեն Հովիկ Մուսայելյանը, որոնց նշանակումը համահունչ էր կանոնադրության պահանջին, քանի որ այդ մարդիկ թե՛ տնտեսության մեջ ճանաչված կազմակերպությունների ղեկավարներ էին, և թե՛ համագործակցում էին համալսարանի հետ, իսկ «Մետրիկա» ՍՊԸ–ի մասին որևէ մեկը չի լսել»,–ասաց նա՝ ընդգծելով, որ նույնիսկ մեկ անդամի նշանակման իրավական հիմքի խախտումն առ ոչինչ է դարձնում խորհրդի ցանկացած որոշում։

 

ԵՊՀ դասախոսի կարծիքով՝ ԵՊՀ հոգաբարձուների խորհրդի կազմը հաստատելիս վարչապետը վստահել է ԿԳՄՍ նախարարին։

«Կառավարության կողմից նշանակված ներկայացուցիչներն, ըստ էության, ԿԳՄՍ նախարարության առաջարկած մարդիկ են, քանի որ կառավարության քվոտայով են առաջարկված երկու փոխնախարարները, մինչդեռ օրինակ Կենտրոնական բանկի նախագահը ներկայացվել է ԿԳՄՍ նախարարության կողմից, ինչը ևս անտրամաբանական է և հիմք է տալիս ենթադրելու, որ նշանակումը տեղի է ունեցել ԿԳՄՍ նախարարի առաջարկած սցենարով»,–ասաց ԵՊՀ հոգեբարդուների խորհրդի անդամը՝ հույս հայտնելով, որ դատարանը ոչ իրավաչափ կճանաչի խորհրդի երկու անդամների նշանակումը։
