Նոր զարգացումներ. Քննչական կոմիտեն մեղադրանք կառաջադրի Վլադիմիր Գասպարյանին

Armlur.am-ի տեղեկություններով` ՀՀ քննչական կոմիտեն պատրաստվում է Հայաստանի ոստիկանության նախկին պետ Վլադիմիր Գասպարյանին մեղադրանք առաջադրել լրագրողի մասնագիտական գործունությանը խոչընդոտելու վերաբերյալ քրեական գործով: Ինչպես հայտնի է, օգոստոսի 9-ին «Ազատություն» ռադիոկայանի լրագրողը հաղորդում էր տվել այն մասին, որ նախորդ օրը ժամը 16-ի սահմաններում Սևանա լճի ափամերձ տարածքների ապօրինի կառույցների վերաբերյալ ռեպորտաժ պատրաստելու ընթացքում Սևան-Շորժա ճանապարհահատվածի վրա Գասպարյանը խոչընդոտել է իր և օպերատորների մասնագիտական գործունությանը, հնչեցվել են կյանքի և առողջության համար վտանգավոր բռնություն գործադրելու սպառնալիքներ:

Դեպքի առթիվ նույն օրը Ոստիկանության քրեական ոստիկանության գլխավոր վարչությունում հարուցվել է քրեական գործ՝ Քրեական օրենսգրքի 164-րդ հոդվածի («Լրագրողի մասնագիտական օրինական գործունեությանը խոչընդոտելը») 3-րդ մասով, որով նախաքննությունը կատարվում է Քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում: Վլադիմիր Գասպարյանի արձագանքը տեղի ունեցածի վերաբերյալ չուշացավ։ Նախկին ոստիկանապետի փաստաբան Տիգրան Աթանեսյանն իր ֆեյսբուքյան էջում իր բառերով` Վլադիմիր Գասպարյանի անվան անհարկի շահարկումը դադարեցնելու համար պարզաբանեց. «մարդու անձնական և ընտանեկան կյանքին ապօրինի ներխուժումը թուլատրելի չէ ոչ մեկին, այդ թվում՝ իշխանահաճո լրատվամիջոցի լրագրողներին և նույնիսկ իրավապահ մարմիններին: Թռչող նկարահանող սարքի՝ «դռոնի» գործարկումը անձի սեփականությունը հանդիսացող տան և տնամերձ տարածքի վրա, առանց իր համաձայնության, անբարոյականություն է և որևէ կապ չունի լրագրողական գործունեության հետ: Իրենց անբարո վարքի համար միանգամայն համաչափ արձագանքի արժանացած «դրոն քշողներինե սա պետք է դաս լինի և հետագայում զերծ պահի ՀՀ քաղաքացիների սահմանադրական իրավունքները խախտելուց»:

Իսկ հաջորդ օրը փաստաբանը տեղեկացրեց, որ պատրաստվում է դատական հայց ներկայացնել նախկին ոստիկանապետի անունից` կապված Ազատություն ռադիոկայանի աշխատակիցների գործողությունների հետ. «ՀՀ քաղաքացու սահմանադրական իրավունքները՝ բնակարանի անձեռնմխելիության, անձնական և ընտանեկան կյանքի գաղտնիության իրավունքները, պետք է պաշտպանված լինեն բոլորից, այդ թվում ապազգային, անհայրենիք ուժերի ոտնձգություններիցե, – ասվում էր հայտարարության մեջ։ Արդյունքում, ՀՀ քննչական կոմիտեն քննության առարկա է դարձնում նաեւ փաստաբանի հայտարարությունը եւ մերժում է մարդու անձնական և ընտանեկան կյանքին ապօրինի ներխուժման մասով քրեական գործի հարուցում եւ այդ որոշումը ուղարկել է դատախազություն: Փոխարենը մեզ հասած տեղեկությունների համաձայն, ՀՀ քննչական կոմիտեն պատրաստվում է մեղադրանք առաջադրել ՀՀ նախկին ոստիկանապետ Վլադիմիր Գասպարյանին:
