ԱԱԾ–ում ավարտվել է ՀՀ սնանկության դատարանի աշխատակազմի ղեկավարի նկատմամբ հարուցված քրգործի նախաքննությունը և ուղարկվել դատարան

ՀՀ ազգային անվտանգության ծառայության քննչական դեպարտամենտում հարուցված և քննված քրեական գործի նախաքննությամբ ձեռք է բերվել բավարար ապացույցների համակցություն առ այն, որ ՀՀ սնանկության դատարանի աշխատակազմի ղեկավարը, 2019-2020 թվականների ընթացքում, շահադիտական դրդումներից ելնելով, օգտագործելով իր պաշտոնեական դիրքը, թվով 5 անձանց  հրամանագրել է ՀՀ սնանկության դատարանի աշխատակազմի հնոցապանի, համակարգչային օպերատորի, էլեկտրագետի, սպասարկողի, ցրիչի հաստիքներում և հաստատապես տեղյակ լինելով վերջիններիս կողմից աշխատանքի չհաճախելու և աշխատանքային պարտականությունները չկատարելու հանգամանքի մասին՝ կազմել, հաստատել և իր ստորագրությամբ վավերացրել է իրավունք վերապահող պաշտոնական փաստաթուղթ հանդիսացող, բովանդակությամբ կեղծ՝ աշխատաժամանակի հաշվարկի տեղեկագրեր, աշխատակազմի աշխատողներին հաշվարկված և վճարված աշխատավարձերի փաստաթղթեր, միանվագ պարգևատրման մասին հրամաններ:

Այնուհետև բովանդակությամբ կեղծ փաստաթղթերը շրջանառության մեջ դնելով՝ ներկայացրել է վճարման, որի արդյունքում պետական բյուջեից, չաշխատած օրերի դիմաց, վերջիններիս անվամբ անհիմն դուրս է գրվել առանձնապես խոշոր չափերով՝ 7.348.576 ՀՀ դրամ: Ավելին՝ Գ. Ժ.-ի և Վ.Վ.-ի աշխատավարձի վճարման բանկային քարտերը փաստացի գտնվել են աշխատակազմի ղեկավարի տրամադրության տակ և նա վերջիններիս անվամբ փոխանցված ընդհանուր՝ 3.638.425 դրամը, անձամբ, տարբեր բանկոմատներից կանխիկացրել և ծախսել է իր անձնական կարիքների համար, իսկ մնացած՝ 3.710.151 դրամ գումարը տնօրինվել է Կ. Գ.-ի, Ե. Մ.-ի և Ա. Կ.-ի կողմից։

Նկարագրված արարքը կատարելու համար 2020 թվականի հուլիսի 29-ին ՀՀ սնանկության դատարանի աշխատակազմի ղեկավարը ներգրավվել է որպես մեղադրյալ և նույն օրը նրան մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի  1-ին կետով և 314-րդ հոդվածի 1-ին մասով:

Առաջադրված մեղադրանքում ՀՀ սնանկության դատարանի աշխատակազմի ղեկավարն իրեն մեղավոր է ճանաչել լիովին և տվել խոստովանական ցուցմունքներ՝ ամբողջությամբ հատուցելով նաև պետությանը պատճառված վնասը:

Միևնույն ժամանակ դատավարական ղեկավարում իրականացնող դատախազի  համաձայնության առկայության պայմաններում վարույթն իրականացնող մարմնի կողմից որոշում է կայացվել ՀՀ սնանկության դատարանի աշխատակազմի ղեկավարի պաշտոնում՝ մեղադրյալի պաշտոնավարությունը ժամանակավոր դադարեցնելու մասին:

Նախաքննության ընթացքում միջնորդագիր է ուղարկվել ՀՀ Դատական դեպարտամենտի ղեկավարին՝ ՀՀ սնանկության դատարանի աշխատակազմում նույնաբնույթ խախտումները վերացնելու, դրանց պատճառները պարզելու և խախտումներ թույլ տրված անձանց նկատմամբ կարգապահական ներգործության միջոցներ կիրառելու առաջարկությամբ:

2020 թվականի սեպտեմբերի 14-ին քրեական գործը, մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության նկատմամբ դատավարական ղեկավարում իրականացնող դատախազին՝ մեղադրական եզրակացությունը հաստատելու և գործն ըստ էության քննության առնելու նպատակով դատարան ուղարկելու նպատակով։

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով՝ դատարանի՝ օրինական ուժի մեջ մտած դատավճռով:
