ԱԺ-ում Սահմանադրական դատարանի դատավորի թեկնածուի ընտրության հարցի քննարկման ժամանակ ԱԺ «Իմ քայը» խմբակցության պատգամավոր Տաթևիկ Հայրապետյանը թեկնածու Երվանդ խունդկարյանից հետաքրքրվեց, թե ինչպե՞ս է վերջինս վերաբերվում Գերագույն դատարան ստեղծելու մտքին:

Երվանդ Խունդրակյանը նշեց, որ մենք տարիներ ի վեր ընտրել ենք ուղղություն, քայլել ենք որոշակի ուղղությամբ և ներկայումս Սահմանադրական դատարանի և Վճռաբեկ դատարանի գործառույթներն էականորեն իրարից տարբերվում են:

«Սահմանդրական դատարանը ստեղծվելով 1996-ից՝ մեծ ջանքեր և մեծ աշխատանք է տարել Սահմանադրական արդարադատության ներդրման և կայացման համար, իսկ Վճռաբեկ դատարանը 1998 թվականի ստեղծումից ի վեր բավականին մեծ աշխատանք է արել հասարակության մեջ դատական նախադեպի մշակույթը ձևավորելու և զարգացնելու տեսանկյունից: Դատական իշխանություն կրողներս, մենք՝ դատավորներս, շատ ավելի պահպանողական բնավորություն ունենք և, իմ կարծիքով, դատական իշխանության հետ կապված ցանկացած գործողություն ավելի շատ պահպանողական մտածելակերպից պետք է բխի և կտրուկ փոփոխություններն ինձ համար անընդունելի են»,- ասաց նա:

Երվանդ Խունդկարյանն ընդգծեց՝ իր համար շատ ավելի արժեքավոր է ֆիքսել կոնկրետ իրավիճակը, հասկանալ, թե որոնք են այն խնդիրները և վերացնել դրանք, քան գնալ ավելի մեծ անորոշության և նոր հասկանալ, թե ինչքան նոր խնդիրներ կարող ենք ստեղծել մարդու իրավունքների պաշտպանության բնագավառում:

«Ինչևէ, կլինի Իքս կամ Իգրեկ մոդելը, դա իմ որոշելիքը չէ, ես ընդամենը կարող եմ իմ կարծիքը հայտնել, բայց ցանկացած փոփոխություն պետք է խիստ կշռադատված լինի և ցանկացած փոփոխության կենտրոնում պետք է լինի թիվ մեկ հիմնախնդիրը՝ մարդու իրավունքների պաշտպանության իրագործումը»,- շեշտեց նա:
