«Սև բերդ» ամրոցն ապօրինաբար օտարվել է ֆիզիկական անձի․ բացահայտում

ՔՈԳՎ կոռուպցիոն և տնտեսական հանցագործությունների դեմ պայքարի վարչությունում նախապատրաստված նյութերով փաստական տվյալներ են ձեռք բերվել, որ Կառավարության 1995 թվականի հունիսի 6-ի կարգադրությամբ՝ Գյումրու «Սև բերդ» ամրոցը հանձնվել է պաշտպանության նախարարության հաշվեկշիռ, որը «Պատմության և մշակույթի անշարժ հուշարձանների ու պատմական միջավայրի պահպանության և օգտագործման մասին» ՀՀ օրենքի 13-րդ հոդվածի համաձայն՝ կառավարության 2004 թվականի սեպտեմբերի 9-ի որոշումով ընդգրկվել է Շիրակի մարզի պատմության և մշակույթի անշարժ հուշարձանների պետական ցուցակում, իսկ 2005 թվականի ապրիլին ՀՀ ԱԳԿՊ կոմիտեի Գյումրու տարածքային ստորաբաժանման կողմից տրված՝ սեփականության իրավունքի վկայականով հանձնվել է պաշտպանության նախարարությանը։

 

Այնուհետև պաշտպանության և արդարադատության նախարարությունների բարձրաստիճան և այլ իրավասու պաշտոնատար անձինք, անձնական այլ շահագրգռվածությունից ելնելով, իրենց լիազորությունները ծառայության շահերին հակառակ օգտագործելով և խախտելով «ՀՀ պետական սեփականություն համարվող և օտարման ոչ ենթակա պատմության և մշակույթի անշարժ հուշարձանների մասին» ՀՀ օրենքի 2-րդ հոդվածի «Բ» ենթակետի պահանջները, ապօրինի կազմակերպել են սեփականության իրավունքով ՀՀ պաշտպանության նախարարությանը պատկանող՝ հանրապետական նշանակության Գյումրու «Սև բերդ» ամրոց-հուշարձանը ֆիզիկական անձին օտարելու գործընթացը, որի շրջանակներում ձևական հղում կատարելով տվյալ հուշարձանի օտարմանն առհասարակ չվերաբերող՝ պաշտպանության նախարարության տնօրինությանը հանձնված հողամասերն օտարելու թույլտվության վերաբերյալ Կառավարության 2005 թվականի հունվարի 25-ի որոշմանը, պաշտպանության նախարարության լիազորված անձի և գնորդ հանդիսացած ֆիզիկական անձի միջև կնքվել է առուվաճառքի պայմանագիր, որն էլ «Նոտարիատի մասին» ՀՀ օրենքի 52-րդ հոդվածի պահանջների խախտմամբ 2005 թվականի մայիսի 11-ին վավերացվել է Կենտրոն նոտարական տարածքի նոտարի կողմից։

 

Այնուհետև ԱԳԿՊ կոմիտեի տարածքային ստորաբաժանման իրավասու պաշտոնատար անձինք, նույնպես անձնական այլ շահագրգռվածությունից ելնելով չարաշահելով իրենց պաշտոնեական լիազորությունները և խախտելով «Գույքի նկատմամբ իրավունքների պետական գրանցման մասին» ՀՀ օրենքի 30-րդ հոդվածի պահանջները, 2005 թվականի մայիսի 19-ին «Սև բերդ» ամրոցը գրանցել են հիշյալ ֆիզիկական անձի անվամբ, ինչի հետևանքով պետությանը՝ ի դեմս ՀՀ պաշտպանության նախարարության օրինական շահերին պատճառվել է էական վնաս։

Դեպքի առթիվ ՔՈԳՎ-ում հարուցվել է քրեական գործ, որն ուղարկվել է Քննչական կոմիտե։
