Դեռևս չեմ տեսել լուրջ հիմնավորում, որ երկու դատարանների միավորումն արդյունավետ է: Այս մասին Tert.am-ի հետ զրույցում ասաց փաստաբան Հովհաննես Խուդոյանը՝ անդրադառնալով Սահմանադրական և Վճռաբեկ դատարանների հնարավոր միավորմանն ու Գերագույն դատարան ստեղծելուն:

Անդրադառնալով դիտարկումներին, թե սա արդարադատության ոլորտում էքսպերիմենտ է, Խուդոյանն արձագանքեց. «Ցանկացած ոլորտում կարող է լինել էքսպերիմենտ, եթե ընդհանուր, բաց համակարգային գործողություն է, ոչ թե զուտ գաղափար՝ «որ ունենանք այսպիսի մարմին, լավ կլինի»: Պետք է լինի կոնկրետ մշակված փաթեթով, առաջադրանքներով: Նախագծին դեմ ու կողմ մեկնաբանությունները շատ պարզունակ են: Օրինակ՝ քննարկվում է, որ առաջին ատյանի դատարանի դատավորները կարողանան նորմի սահմանադրականության հարց բարձրացնել, հիմա էլ են կարողանում»,-նշեց նա:

Ինչ վերաբերում է ռեսուրսներ ծախսելուն, Խուդոյանի դիտարկմամբ, արդարադատությունն այն ոլորտը չէ, որտեղ պետք է խնայել, քանի որ բոլոր ոլորտների խնդիրները վերջնական համակարգում են ստանում արդարադատության ոլորտում:

Նրա խոսքով՝ շատ երկրներում մեկ ատյանով՝ Գերագույն դատարանով աշխատում են, և այնպես չէ, որ դա այն ինստիտուտն է, որ դատապարտված է տապալման. «Բայց, համենայն դեպս, դրա համար շատ լուրջ աշխատանք պետք է տարվի՝ անցումային շրջանով, որը այս հապշտապ վիճակում ես չեմ պատկերացնում, որ դրական արդյունք կտա»,-ասաց փաստաբանը:

Ինչ վերաբերում է դիտարկումներին, թե երկու կայացած կառույցներ են կազմաքանդվում, փաստաբանը նշեց, թե ինքը քանդելուն դեմ չէ, այլ հարց է՝ դրան ինչ է նախորդել. «Քանդելուց առաջ պետք է ունենալ հստակ, հիմնավորված պլան, թե ինչպես ես նորը կառուցում, իսկ հիմա այս քննարկումների ընթացքում նման բան չենք տեսել. գուցե կա, չի հանրայնացվում»,-ասաց Խուդոյանը:

Նա ընդգծեց՝ չի կարող ասել՝ իշխանությունները սրանով ինչ նպատակ են լուծում, քանի որ դեռևս չի տեսել որևիցե խնդիր, որ լուծվում է արդարադատության ոլորտում:

Խուդոյանը համաձայն է այն կարծիքներին, թե արդարադատության ոլորտում կան որոշ՝ ավելի առաջնահերթ խնդիրներ, որոնք պետք է ավելի արագ լուծում ստանային, քան երկու դատարանների միավորումն է:

«Բոլորը համակարծիք են, որ արդարադատության ոլորտում առաջնահերթ կարևորության խնդիր կա՝ աշխատանքային պայմանների արդիականացումը ու դատավորների ծանրաբեռնվածության նվազումը: Դա ևս ծախսատար է, բայց պետությունը պետք է այդ ռեսուրսը ներդնի ու դրանից հետո ստուգի՝ աշխատու՞մ է այդ կերպ, թե՞ ոչ: Որովհետև, եթե դատավորը բարեխիղճ է, բայց, ամեն դեպքում, աշխատում է ծանրաբեռնված, միևնույն է՝ լավ չի աշխատելու: Եթե աշխատանքի ծանրաբեռնվածությունը թեթևացվի, արդեն պարզ կլինի՝ նա բարեխի՞ղճ է, թե՞ ոչ: Դա նաև հնարավորություն կտա ձերբազատվել վատ աշխատողներից ու խրախուսել նրանց, ովքեր դրական համբավ ունեն»,-ասաց Հովհաննես Խուդոյանը:
