ՍԴ-ում ճգնաժամ է․ պաշտոնավարումը դադարած 3 դատավորների 14 գործերը չեն մակագրվել այլ դատավորների և այլևս չեն էլ կարող վերամակագրվել, դրա համար նախատեսված է եղել 21 օր, որն արդեն իսկ անցել է․ իրավաբան

Իրավաբան Ռոբերտ Հայրապետյանը ֆեյսբուքյան գրառմամբ անդրադարձել է Սահմանադրության վերջին փոփոխություններից հետո ՍԴ-ում ստեղծված իրադրությանը՝ այն որակելով ճգնաժամ։ Նա մասնավորապես նշել է, որ պաշտոնավարումը դադարած երեք դատավորների 14 գործերը չեն մակագրվել այլ դատավորների և այլևս չեն կարող վերամակագրվել, քանի որ ՍԴ մասին օրենքով նշված գործողությունը կատարելու համար նախատեսված է եղել 21 օր, որն արդեն իսկ անցել է։ Հայրապետյանի գրառումը՝ ստորև․

«Ինչպես գիտենք Սահմանադրության վերջին փոփոխություններից հետո Սահմանադրական դատարանում առկա է իրական ճգնաժամ (ժամկետներին առնչվող տվյալները փոքր ինչ շեղումներ կարող են տալ՝ հաշվի առնելով, որ դիմումների մուտքագրման օրերը հաշվարկվել են՝ հիմք ընդունելով աշխատակարգային կամ դատական կազմի որոշումների կայացման միջինացված ժամկետները), մասնավորապես՝

պաշտոնավարումը դադարած երեք դատավորների 14 գործերը չեն մակագրվել այլ դատավորների: Ընդ որում, դրանք այլևս չեն կարող վերամակագրվել, քանի որ ՍԴ մասին օրենքով նշված գործողությունը կատարելու համար նախատեսված է եղել 21 օր, որն արդեն իսկ անցել է (ի դեպ, օրենքի ուժի մեջ մտնելու պահին արդեն իսկ ժամկետն անցած է եղել):

12-14 գործով անցել են քննության վերջնաժամկետները /(այդ թվում՝ սկզբնական եռամսյա ժամկետը, որը չի երկարաձգվել, ուստի չի էլ կարող երկարաձգվել հետագայում):

25 գործով անցել են նշանակված նիստերի դատաքննության օրերը:

Ինչ է սա նշանակում: Սա նշանակում է որ այս գործերից շատերը մնացել են առկախված, ինչու ոչ՝ դուրս են եկել ՍԴ օրակարգից: Արդյունքում, խախտվել են բազմաթիվ դիմումատուների իրավունքներ, վտանգվել է բազմափիվ միջազգային պայմանագրերի վավերացման գործընթացը, որոնք կենսական նշանակություն ունեն պետության համար(այդ թվում՝ ֆինանսական առումով): Բացի այդ, նշված իրավիճակը պետության համար կարող է ստեղծել լրջագույն ֆինանսական բեռ, եթե հանկարծ շահագրգիռ իրավաբանական և ֆիզիկական անձինք դիմեն ՄԻԵԴ՝ ՄԻԵԿ-ի 6-րդ հոդվածի, մասնավորապես՝ գործի քննության ողջամիտ ժամկետի խախտման համատեքստում:

Իսկ ինչ են անում իշխանությունները: Նշված անձինք, ովքեր երկրի միակ օրակարգը կառուցել էին ՍԴ «ճգնաժամը» լուծելու շուրջ՝ կասկածի տակ դնելով նաև երկրի հեղինակությունը, իրական ճգնաժամի պայմաններում մատնվել են անգործության և նույնիսկ չեն բարեհաճում օրենսդրական կարգավորումների միջոցով առկա իրական ճգնաժամը հարթելու փորձ անել:

Դե իսկ ՍԴ ինքնահռչակ նախագահ Վահե Գրիգորյանն էլ, ով պարբերաբար առաջարկներ էր անում իշխանության տարբեր թևերին ու մուննաթ գալիս այդ առաջարկները լիովին չիրացնելու համար, այս անգամ զբաղված է շատ ավելի կարևոր գործով՝ ծածուկ կերպով մեկ այլ դատավորի աշխատասենյակի զավթմամբ»:
