Գերագույն դատարանը մեր երկրի ժողովրդավարական ապագայի համար լուրջ խնդիր եմ համարում․ Վիգեն Քոչարյան

Այո, ես ունեմ շատ լուրջ և չփարատված մտահոգություններ` այս հնարավոր միավորման հետ կապված: Ամենահիմնավոր մտահոգությունս հանգում է նրան, որ մենք, ստեղծելով Գերագույն դատարան և օժտելով նրան բոլոր այն լիազորություններով, որոնք ունի ՍԴ-ն և Վճռաբեկ դատարանը, ստեղծում ենք դատական իշխանության գերկենտրոնացում, որը որևէ կերպ չի կարող նպաստել մեր առջև կանգնած խնդիրների լուծմանը և կարող է նոր և լուրջ խնդիրների պատճառ դառնալ:

Այս մասին այսօր «Բարձրագույն դատական ատյանները սահմանադրական բարեփոխումների հայեցակարգում» թեմայով քննարկման ժամանակ ասաց ԲԴԽ գիտական անդամ Վիգեն Քոչարյանը:

«Ես կարող եմ հավաստել, որ աշխարհում չկա որևէ գերագույն դատարան, որն ամբողջ ծավալով ունենա այն բոլոր լիազորությունները, որոնք այսօր մեր գործընկերներն առաջարկում են ուղղակի գումարման միջոցով օժտել Գերագույն դատարանին»,- ասաց նա և հավելեց, որ մեծ է գայթակղությունը` կուտակված խնդիրները մեկ քայլով լուծելու, սակայն ըստ նրա՝ դա ավելի մեծ և լուրջ խնդիրների ծագման պատճառ լինել:

Նա նշեց, որ ներկայիս գործող համակարգի տրամաբանությունը ուղղահայացության բացակայության մեջ է, և դատարաններն իրանից տարբերվում են իրենց գործառույթներով, նրա որակմամբ՝ Գերագույն դատարանի ստեղծմամբ ուղղակի ենթակայեցնում են ստորադաս դատարանները Գերագույն դատարանին:

Քոչարյանը դիտարկեց՝ մեկտեղելով դատարանները` խախտվում են դրանց գործառույթները: «Այստեղ մեծ վտանգ կա, որ կարող է ձևավորվել մի մարդկանց խումբ, որը կոչվում է Գերագույն դատարան, որն էլ իր ձեռքում կկենտրոնացնի օրենսդրության, մեկնաբանման, Սահմանադրության, կոնկրետ գործերի լուծման բոլոր գործառույթները: Ես սա մեր երկրի ժողովրդավարական ապագայի, պետության կառույցի կայունության համար լուրջ խնդիր եմ դիտարկում»:
