«Օշականցի Գևորիկը» կալանավորվեց

ՀՀ ազգային անվտանգության ծառայության քննչական դեպարտամենտում հարուցված քրեական գործի շրջանակներում ձեռք են բերվել բավարար ապացույցների համակցություն այն մասին, որ «Օշականցի Գևորիկ» մականվամբ Գ. Մ.-ն իր բնակության հասցեում շինարարական աշխատանքեր իրականացնող Գ. Ի.-ի և վերջինիս մորեղբոր տղայի Ա. Ի.-ի միջոցով իրեն դիմած Ա.Պ.-ի օգտին մասնավոր հարցին առնչվող, այն է՝ նախկինում գրավադրված ոսկու դիմաց պարտք մնացած և ձկան վաճառքից գոյացած գումարները Ս. Ս.-ի կողմից չվճարելու վերաբերյալ առաջացած վեճը (խնդիրը) լուծելու համար, 2020թ. մայիսի 17-ից սկսած զանգահարել է Ս. Ս.-ին և անօրինական ազդեցությունն օգտագործելով և սպառնալիքի միջոցով պահանջել հանդիպել իրեն, սակայն վերջինիս կողմից տարբեր պատճառաբանություններով հանդիպումը հետաձգելու պայմաններում, հետագա խոսակցություններից մեկի ընթացքում սպառնացել է իր հեղինակությունն ու քրեական աստիճանակարգության բարձրագույն կարգավիճակից բխող հնարավորություններն օգտագործելով բռնություն գործադրել Ս. Ս.-ի նկատմամբ, որպիսի գործողություններից խուսափելու համար հանձնարարել է նրան համաձայնության գալ պարտատիրոջ՝ Ա. Պ.-ի առաջարկի հետ: Դրանից հետո Ա. Պ.-ն, օգտվելով Գ.Մ.-ի հովանավորչությունից, Ս. Ս.-ից որպես նյութական օգուտ և այլ առավելություն պահանջել է 4.800 ԱՄՆ դոլար, 1.550.000 ՀՀ դրամ և նրան պատկանող Արմավիրի մարզում գտվող ձկնաբուծական լճերի ափամերձ հատվածի հողատարածքի սեփականության վկայականը:

Նկարագրված արարքը կատարելու համար Գ. Մ.-ն ներգրավվել է որպես մեղադրյալ և նրան մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 223.1-րդ հոդվածի 1-ին մասով, որպես խափանման միջոց է ընտրվել կալանավորումը:

Նույն գործի շրջանակներում քրեական ենթամշակույթ կրող խմբավորմանը մասնակցելու կամ ներգրավելու, քրեական ենթամշակույթ կրող խմբավորման մասնակցին կամ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձին դիմելու համար մեղադրանք է առաջադրվել ևս երկու անձի, որոնցից մեկի նկատմամբ խափանման միջոց է ընտրվել ստորագրություն չհեռանալու մասին, իսկ մյուսի նկատմամբ միջնորդություն է հարուցվել Դատարան՝ կալանավորումը որպես խափանման միջոց կիրառելու թույլտվություն ստանալու վերաբերյալ:

Նախաքննությունը շարունակվում է, կատարվում են անհետաձգելի քննչական և այլ դատավարական գործողություններ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձանց կողմից այլ հանցավոր դրսևորումները բացահայտելու, քրեական ենթամշակույթ կրող խմբավորմանը մասնակցած կամ ներգրավված անձանց ամբողջական շրջանակը պարզելու և նրանց արարքին համարժեք քրեաիրավական գնահատական տալու և արդյունքում ՀՀ քրեական դատավարության օրենսգրքի 2-րդ հոդվածով նախատեսված խնդիրներն արդյունավետ կենսագործելու ուղղությամբ:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով՝ դատարանի՝ օրինական ուժի մեջ մտած դատավճռով:
