Արտակարգ դրությունը չի երկարաձգվի, բայց կարող են հայտարարվել կարանտիններ. Ինչ սահմանափակումներ են սահմանվել

Կառավարությունն իր այսօրվա՝ օգոստոսի 27-ի նիստում հվանություն տվեց նախագծերի փաթեթին, որը թույլ կտա առանց արտակարգ դրությունը երկարաձգելու շարունակել համաճարակի դեմ պայքարը եւ հասնել քաղաքացիների կյանքն ու առողջությունը պաշտպանելուն: Նախագիծն այսօրվա նիստում զեկուցեց Արդարադատության նախարար Ռուստամ Բադասյանը:

Բադասյանը նշեց, որ առաջարկում են փոփոխություններ կատարել հիմնականում 2 օրենքներում՝ «Հայաստանի Հանրապետության բնակչության սանիտարահամաճարակային անվտանգության ապահովման մասին» եւ «Արտակարգ իրավիճակներում բնակչության պաշտպանության մասին» օրենքներում:

Նախարարի խոսքով, օրենքների փաթեթն ընդունվելու դեպքում, սեպտեմբերի 11-ից հետո արտակարգ դրությունն այլեւս չի երկարաձգվի, դրա փոխարեն կգործեն նոր փոփոխություններով սահմանված սահմանափակումները:

Նախագծերով վարակիչ հիվանդությունների ՀՀ տարածք ներբերման, ներթափանցման, դրանց ծագման եւ տարածման վտանգի, բռնկումների, համաճարակի առաջացման, ինչպես նաեւ դրանց հետեւանքով արտակարգ իրավիճակ առաջանալու դեպքում կարող է սահմանվել կարանտին:

Կարանտին կարող է սահմանվել առողջապահության բնագավառում պետական լիազոր մարմնի առաջակությամբ, մարզպետի կամ Երեւանի քաղաքապետի կողմից՝ առանձին տարածքներում, իսկ կառավարության կողմից՝ ամբողջ Հայաստանում:

Նախարարը նշեց, որ մարզպետի կամ Երեւանի քաղաքապետի կողմից կարանտին հայտարարելու դեպքում հնարավոր կլինի կիրառել հետեւյալ միջոցառումները՝ համաճարակի գտտում մուտքի եւ ելքի հատուկ ռեժիմի սահմանումպետական սահմանով հաղորդակցության ժամանակավոր դադարեցում կամ սահմանափակում, անձանց ազատ տեղաշարժվելու իրավունքի եւ տրանսպորտային միջոցների  տեղաշարժման սահմանափակումներ, օբզերվացիա, ինքնամեկուսացում ու մեկուսացում:

Այն դեպքերում, երբ կարանտին կսահմանվի կառավարության կողմից, ի թիվս նշվածի, հնարավոր կլինի կիրառել ավելի խիստ միջոցառումներ, որոնցից են՝ հավաքներ կամ հանրային միջոցառումներ կազմակերպելու կամ դրանց մասնակցելու  սահմանափակումներ, իրավաբանական անձանց գործունեության սանիտարահամաճարակային անվտանգության կանոնների սահմանում, ապրանքների փոխադրման սահմանափակումներ, կրթական հաստատությունների  գործունեության սահմանափակումներ, սահմանափակումներ պետական եւ ՏԻՄ մարմիններում եւ այլ հաստատություններում»,-ասաց Բադասյանը՝ հավելելով, որ սահմանափակումները համապատասխանեցվել են Սահմանադրությանը:

Նա հավելեց, որ սահմանվել են նաեւ նորմեր որոնք հնարավորություն կտան կարճ ժամկետներում քննել կարանտին սահմանելու դեպքում կիրառվող միջոցների իրավաչափության վիճարկման վերաբերյալ գործերը: Մասնավորապես առաջին ատյանի դատարանում ժամկետ է սահմանվել 10 օրը, իսկ վերաքննիչ դատարանում՝ երկու ամիս:

Արտակարգ դրությունը հանելուց եպքում չի գործի էլեկտրոնային գործիքներով մարդկանց տեղորոշման համակարգը, նաեւ տնտեսական գործունեության արգելման դեպքերը:
