Անախրոնիզմ, քաղաքական նպատակ հետապնդող քայլ, պետության վրա բեռի ավելացում. իրավաբանները՝ ՍԴ-ն և Գերագույն դատարանը միավորելու մասին

Սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովն այսօր ներկայացրել է որոշ կետեր հանձնաժողովի բարեփոխումների հայեցակարգի նախնական տարբերակից, ըստ որի՝ Սահմանադրական և Վճռաբեկ դատարանները նախատեսվում է միավորել մեկ ատյանի մեջ, բացի այդ, ՀՀ յուրաքանչյուր դատարան լիազորված կլինի իր վարույթում քննվող գործի շրջանակում օրենքի սահմանադրականության վերաբերյալ որոշում կայացնել։

Ոլորտի մասնագետները քննադատել, նաև հեգնանքով ու ծաղրանքով են անդրադարձել երկու դատարանները միավորելու գաղափարին: Մասնավորապես, փաստաբան Տիգրան Աթանեսյանն այն «անիմաստ անախրոնիզմ» է անվանել:

«Սահմանադրական բարեփոխումների հանձնաժողովը որոշել է Վճռաբեկ և Սահմանադրական դատարանները միավորել ու ստեղծել Գերագույն դատարան: Անիմաստ այս նախաձեռնությունը կարելի է լրացնել նոր անախրոնիզմներով և, օրինակ, միավորել հանրապետության նախագահի և վարչապետի պաշտոնները և այն կոչել Առաջին քարտուղար կամ էլ Էրիվանի խան ...»,- գրել է նա:

«Իրավական ուղի» ՀԿ համահիմնադիր Ռուբեն Մելիքյանը գրել է, որ դրանով իշխանություններն ստեղծում են «մի նոր մարմին՝ ԱՄՆ Գերագույն դատարան»: «Փաստորեն՝ Սահմանադրական բարեփոխումների մասնագիտական (այս բառը, կարծում եմ, կատակով են գրել) հանձնաժողովը որոշել է ՀՀ Սահմանադրական դատարանը և ՀՀ Վճռաբեկ դատարանը միավորել՝ ստեղծելով մի նոր մարմին՝ ԱՄՆ Գերագույն դատարան։ ՀԳ. Այս որոշումը կայացվել է ձայների չնչին տարբերությամբ»,- գրել է նա։

Երվանդ Վարոսյանն էլ հարց է բարձրացրել՝ նշելով, թե ակնհայտ քաղաքական նպատակներով սա նախաձեռնողներն արդյո՞ք պատկերացնում են, թե դրանով ինչ բեռ են ավելացնում պետության վրա:

«Ոլորտի մասնագետները լավ գիտեն, թե ՀՀ Վճռաբեկ դատարանով անցած ու իրավական լուծում չստացած քանի հարց է իր կարգավորումը ստացել Սահմանադրական դատարանում անցած 25 տարիների ընթացքում։

Հիմա սահմանադրական ու վճռաբեկ դատարանները բացարձակ անհասկանալի քաղաքական նպատակներով միցնել ցանկացողները արդյո՞ք գիտակցում են, որ նման քայլով նաև չլուծված խնդիրների բեռ են ավելացնելու պետության վրա»,- գրել է նա։
