Դատարանը մերժեց Մանվել Գրիգորյանի ընկերության գույքի վրա դրված կալանքը վերացնելու միջնորդությունը

Երեւան քաղաքի ընդհանուր իրավասության դատարանում, դատավոր Մնացական Մարտիրոսյանի նախագահությամբ ընթացող ԵԿՄ վարչության նախկին նախագահ, գեներալ Մանվել Գրիգորյանի գործով դատական նիստին պաշտպանները ներկայացրին երկու միջնորդություն։

Պաշտպանները դատական քննության ընթացքում միջնորդել են թույլատրել «Արա եւ Այծեմնիկ» բաց բաժնետիրական ընկերության դրամական միջոցների հաշվին կատարել բյուջեի հանդեպ պարտավորությունները։ Դատարանին ներկայացվեց ընկերության բանկային հաշիվների դրամարկղի մնացորդի հարկային պարտավորությունների վերաբերյալ տեղեկանքները։

Դատարանն արձանագրեց, որ դեռեւս քրեական գործի նյութերը հետազոտված չեն. ««Արա եւ Այծեմնիկի» գույքի վրա արգելանք դնելու մասին որոշումը եւ դրանից բխող հանգամանքները մանրամասն հետազոտված չեն։ Դատարանը լիազորված է որոշում կայացնել թույլատրել, որպեսզի «Արա եւ Այծեմնիկը» կատարի իր հարկային պարտավորությունները»։

Դատարան որոշեց, որ միջնորդությունն անհիմն է եւ ենթակա է մերժման։

Մյուս միջնորդությունը վերաբերում էր քրեական գործի վարույթը կարճելուն՝ գործով ամբաստանյալի ծանր հիվանդության հիմքով։

Դատարանը նիստը հետաձգեց՝ հաջորդ դատական նիստին միջնորդությունը քննելու համար. «Հաջորդ դատական նիստին անհրաժեշտ է ներկայացնել միջնորդությունը հաստատող կամ հերքող ապացույցներ, փաստաթղթեր»։

Հիշեցնենք, որ Մանվել Գրիգորյանի խափանման միջոցը դատարանի որոշմամբ հունվարի 15-ին փոխվեց։
