Նախկին տուգանքները մինչև վերջին լուման պետք է վճարել. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Արդեն երկար ժամանակ է վարորդները բողոքում են ոչ միայն ճանապարհային երթևեկության կանոնների խախտման համար սահմանված վարչական տույժերի ֆանտաստիկ չափերից, այլ՝ դրանք ժամանակին չվճարելու դեպքում 25%, ապա 50%–ի չափով արհեստականորեն «աճեցնելուց»: Տույժի աճեցման այդ մեխանիզմը պարզ էր ու կախված էր օրացույցի օրերից: Որոշ ժամանակ դրանք մի լավ ուռճացվում էին, հետո դրանք կրկին չվճարելու դեպքում, Ճանապարհային ոստիկանությունը «անպարկեշտ» վարորդների տվյալները պաս էր տալիս ԴԱՀԿ–ին: Այստեղ էլ ԴԱՀԿ–ն իր «ծառայության» գինը գումարելով արդեն իսկ մի լավ աճեցված տույժ–տուգանքին, ավելացնում էր իր կողմից կատարվող «ծառայության» գինը և խիղճը կորցրած կալանք դնում տվյալ օրինախախտ վարորդի բանկային ողջ հաշիվների վրա:

Հիմա, երբ բոլոր վարորդները շունչները պահած սպասում են Վարչական իրավախախտումների մասին ՀՀ օրենսգրքում կատարված փոփոխություններն ուժի մեջ մտնելուն, որի շնորհիվ տուգանքի չափը բարեբախտաբար էլ չի աճի, հարց է ծագում, թե նախկինից կուտակված ու մինչ օրս դեռ չվճարված տուգանքների հարցն ինպես կլուծվի:

Ավտովարորդների իրավունքների պաշտպանության «Աքիլես» հասարակական կազմակերպության նախագահ Էդուարդ Հովհաննիսյանը «Փաստի» հետ զրույցում ասաց, որ այն հետադարձ ուժ չի ունենա:

«Նախկին խախտումներին օրենքը չի վերաբերի և մինչև օրենքի ընդունումը կատարված խախտումների համար նշանակված տուգանքները պետք է կիրառվեն: Եվ հարկավոր է մուծել ոչ միայն նախկինում տուգանքին ավելացված 25 և 50 տոկոսը, այլև ԴԱՀԿ–ի ծառայության գումարը: Ի դեպ, օրենքը չի վերաբերում նաև ԴԱՀԿ–ի ծառայության դիմաց գանձվող գումարին: Եվ ինչպես նախկինում էին այն վճարում վարորդները, այնպես էլ օրենքը ուժի մեջ մտնելուց հետո կշարունակեն վճարել»,– ասաց Է. Հովհաննիսյանը:

Կազմակերպության ղեկավարը թե՛ նախկինում և թե՛ հիմա շարունակում է նույն կարծիքին մնալ: Նա պնդում է, որ բոլոր վարորդների համար հարկավոր է հավասար մեկնարկային պայմաններ ապահովել և բոլորի հանդեպ համաներում կիրառել: Եվ այն պետք է ոչ թե որոշ դեպքերի վերաբերի, այլ՝ լայնածավալ բնույթ կրի, որը, ցավոք, նոր օրենքով նախատեսված չէ:

Արդարադատության նախարարությունից էլ «Փաստին» տեղեկացրին, որ Վարչական իրավախախտումների մասին ՀՀ օրենսգրքում կատարված փոփոխությունները կկիրառվեն այն դեպքերում, երբ տուգանքը նշանակվել է օրենքն ուժի մեջ մտնելուց հետո, ինչպես նաև այն դեպքերում, երբ թեև տուգանքը նշանակվել է օրենքը ուժի մեջ մտնելուց առաջ, սակայն դեռ չեն լրացել նույն օրենսգրքով նախատեսված բոլոր ժամկետները:
