Դիմորդների ընդունելության կարգի հետ կապված այս խնդիրը լուծում ունի, ընդ որում՝ իրավական. փաստաբան

Չեմ կարող անմասն մնալ դիմորդների ընդունելության հետ կապված այս խնդրին։

Վստահ եմ, որ դիմորդների ընդունելության կարգի հետ կապված այս խնդիրը լուծում ունի, ընդ որում՝ իրավական լուծում։ Այս մասին գրել է փաստաբան Ծովինար Բալայանը։

Այսպես՝ 2020/2021 ուս․ տարվա բուհական հաստատություններ ընդունվելու կարգը կարգավորվում է ոչ թե Կառավարության կողմից 2020թ․ մայիսի 21-ին ընդունված թիվ 826-Ն որոշմամբ, այլ նախորդ՝ 2012թ․ ապրիլի 26-ին ընդունված թիվ 597-Ն որոշմամբ։

Պատճառը հետևյալն է՝

ՀՀ կառավարությունը 2020թ․ ընդունելով նոր որոշում, որևէ իրավական ակտով ուժը կորցրած չի ճանաչել նախորդ՝ 2012թ․ ընդունված որոշումը։ Ուստի ստացվում է, որ այս պահին գործում է երկու որոշում՝ երկու տարբեր կարգերով։ Մասնավորապես՝ նոր որոշման 59 կետի համաձայն՝ առաջին հայտագրված մասնագիտության մրցույթով չանցած դիմորդները հաջորդ մասնագիտություններ կարող են ընդունվել միայն թափուր տեղերի առկայության դեպքում, իսկ հին կարգի 94 կետի համաձայն՝ կարող էին ընդունվել անկախ նման պայմանից։

Հաշվի առնելով, որ «Նորմատիվ իրավական ակտերի մասին» ՀՀ օրենքի 40-րդ հոդվածը նման դեպքերի համար սահմանում է, որ պետք է նախապատվությունը տալ ավելի վաղ ընդունված կարգին, ուստի տվյալ պարագայում պատկան մարմինները իրավունք չունեն ղեկավարվել նոր կարգով, այլ պետք է ղեկավարվեն հին կարգով և դիմորդների ընդունելության կարգը որոշեն 2012թ․ որոշման դրույթներից ելնելով։ Նման պայմաններում՝ կարծում եմ չընդունված դիմորդներից շատերը, եթե ոչ բոլորը, կհամարվեն բուհ ընդունված։

Բացի այդ, նոր կարգը չի կարող տարածվել մայիսի 25-26-ը դիմած դիմորդների վրա.

Դիմորդների ընդունելության նոր կարգը ուժի մեջ է մտել այս տարվա մայիսի 26-ին, մինչդեռ դիմումների ընդունումը սկսվել է մայիսի 25-ից, այսինքն նոր կարգը առնվազն չէր կարող տարածվել մայիսի 25-ին, եւ նույնիսկ 26-ին դիմած դիմորդների վրա, այսինքն չէր կարող ունենալ հետադարձ ուժ։

Հ/գ Չընդունված դիմորդներին, նրանց ծնողներին և լրատվամիջոցներին կոչ եմ անում առաջացած խնդիրը փորձել բարձրացնել և լուծել նաև այս հիմնավորումներից ելնելով»,– գրել է նա։
