Մենք կանգնած ենք պետականության կորստի առջեւ. Տիգրան Աթանեսյան

Ունենք սահմանադրական հեղաշրջում, բնականաբար, եթե հեղաշրջում է, պետք է անես արագ: Բայց ինչպես միշտ, երբ անում են արագ, ստացվում է վատ: Հեղաշրջում անելու համար էլ է մի քիչ խելք պետք, քանի որ նորմը թողել են ուժի մեջ, այնպես որ այս պահին անիմաստ է, իսկ իմաստը Քոչարյանի գործն էր եւ այդ մարդիկ կարող են քննել Քոչարյանի գործը: Այս մասին Արմնյուզ ՀԸ՝ Անժելա Թովմասյանի «Հայելու առաջ» ծրագրին հայտարարել է փաստաբան Տիգրան Աթանեսյանը՝ ի պատասխան հարցի՝ ինչու այդքան արագորեն ԱԺ-ն ընդունեց սահմանադրական փոփոխությունները:

«Տակը մնացել է ծաղրը եւ դառը հումորը: Տեղի է ունեցել մեծ խաբեություն: Մենք կանգնած ենք պետականության կորստի առջեւ, մի քանի օր առաջ քանդեցինք պետության հիմքը: Ասում եմ՝ մենք, որովհետեւ բոլորս այս երկրի քաղաքացիներ ենք: Բացեիբաց, բաց ճակատով, խարդախի աչքերով նայելով բոլորին տապալել սահմանադրական կարգը եւ ասել, որ սա է պետք երջանկության համար, սա բերում է պետականության կորստի: Վաղը ոչ ոք չի պաշտպանլու այն երկրին, որտեղ ծաղրում են ամեն ինչ, որտեղ ոտնահարում են սրբության սրբոցը», ասել է Տիգրան Աթանեսյանը:

Ես եւս պետք է փաստեմ, որ հունիսի 22-ին երկրում տեղի ունեցավ սահմանադրական հեղաշրջում, իշխող ուժը հասավ իր բաղձալի նպատակին, երկրում ստեղծելով սահմանադրական ճգնաժամ: Այս մասին էլ ասել է սահմանադրագետ Գոհար Մելոյանը:

«Անհասկանի շտապողականությամբ, երբ իշխանությունը տապալել է կորոնավիրուսի դեմ պայքարը, երբ ունենք հարյուրավոր մահեր, 60-րդական հարցն օրակարգ բերվեց եւ օրը ցերեկով սեւով սպիտակին գրելով սահմանադրության դրույթներ խախտվեցին: Առաջին եւ երկրորդ ընթերցմամբ բարձրագույն օրենք խախտվեց: Արագությունն այնքան մեծ էր, որ այդ ամենն ուղեկցվեց բացառիկ փնթիությամբ: Ուեննալու ենք ավելի վատթար կազուսային իրավիճակ: Հանրաքվեով ուզում էին պատասխանատվությունը ժողովրդի վրա գցել, բայց այս օրենքով ամբողջ պատասխանատվությունը մնաց իշխող ուժի վրա: Եթե մինչեւ այս քննադատում էինք, որ իշխող ուժի քայլերը սպառնում են իրավական անվտանգությանը, ապա այժմ արդեն իրավական պետությանը», ասել է Գոհար Մելոյանը:
