Հրայր Թովմասյանի ձիով քայլը, Բուքիքիոյի նամակն ու Ալվինա Գյուլումյանի անսպասելի առաջարկը

Ազգային ժողովոի մեծամասնության ընդունած սահմանադրական փոփոխությունը, որով դադարեցվում են ՍԴ երեք անդամների եւ Հրայր Թովմասյանի՝ որպես ՍԴ նախագահի, լիազորությունները, ուժի մեջ մտնելուց հետո ավելի շատ հարցեր է առաջացրել, քան նման է հանգուցալուծման:

Նույն օրը, երբ ուժի մեջ մտավ այդ փոփոխությունը, հայտնի դարձավ, որ Հրայր Թովմասյանը եւ ՍԴ անդամ Արեւիկ Պետրոսյանը գնացել են արձակուրդ: Նույն օրը ՍԴ աշխատակազմը հրապարակեց նաեւ Վենետիկի հանձնաժողովի նախագահ Բուքիքիոյի պատասխան նամակը Հրայր Թովմասյանին, որում նա գրում է, որ ուշադիր հետևում էր Հայաստանում սահմանադրական փոփոխություններին վերաբերող զարգացումներին։ «Ես ցավում եմ, որ դրանք չեն համապատասխանում Վենետիկի հանձնաժողովի հստակ հանձնարարականներին։ Ես կարող եմ միայն կոչ անել հարգել Սահմանադրությունը։ Դա հանդիսանում է իրավունքի գերակայության սկզբունքի հիմնարար պահանջ», ասվում է նամակում։

Ըստ էության, Վենետիկի հանձնաժողովը դժգոհ է նրանից, որ իշխանությունը չի պահել իր առաջարկած անցումային շրջանը եւ չի պահպանվում իրավունքի գերակայությունը:

ԱԺ ընդունած ակտի սահմանադրականությունը վիճարկում են ընդդիմադիրները, իրավապաշտպանները, ԲՀԿ-ն այդ հարցով դիմել է Սահմանադրական դատարան: Վենետիկի հանձնաժողովի նախագահի նամակում փաստացի ասվում է, որ գործընթացը խնդիր ունի սահմանադրականության հետ:

ՍԴ անդամ Ալվինա Գյուլումյանը շարունակում է գնալ աշխատանքի, հայտարարելով, որ ընդունված փոփոխությունն իր վրա չի տարածվում, եւ ինքը պատրաստ է գնալ մինչեւ Մարդու իրավունքի եվրոպական դատարան: Տեղեկություն է տարածվել, որ ՍԴ իշխանության կողմից նշանակված դատավոր Վահե Գրիգորյանը եւ եւս մեկ դատավոր փորձում են նրան համոզել, որ չհամառի, այլապես դա կունենա իրավական հետեւանքներ:

Կհամոզվի՞ Ալվինա Գյուլումյանը: Նախօրեին նա լրագրողների հետ զրույցում ասել էր, որ շարունակելու է աշխատել, քանի դեռ չկա անհատական ակտ, որ իր պաշտոնավարումը պետք է դադարեցվի: Նա պնդել է, որ որեւէ մեկը դեռեւս չի արձանագրել, որ իր լիազորություններն ավարտված են: Ավելին, այդ պարագայում նա պետք է ստանձնի ՍԴ նախագահի լիազորությունը նախագահի բացակայության պայմաններում:

Ալվինա Գյուլումյանի նշած ակտն, իր հերթին, կարող է խնդրահարույց լինել. ընդհանրապես, ինչպես պնդում են իրավաբանները, ՍԴ դատավորները չեն կարող փոխվել, քանի դեռ «Սահմանադրական դատարանի մասին» ՀՀ Սահմանադրական օրենքի 88-րդ հոդվածը չի փոխվել, եւ դա համարել են իշխանության փնթի գործունեության արդյունք:

Ի՞նչ կլինի, եթե Ալվինա Գյուլումյանը եւ ՍԴ մյուս անդամները շարունակեն գնալ աշխատանքի, իսկ Հրայր Թովմասյանը շարունակի ինքզինքը համարել ՍԴ նախագահ: Իրավական հետեւանքնե՞ր, օրինակ՝ իշխանության յուրացում: ՍԴ անդամներից մեկն, իր հերթին, հնարավոր է համարել, որ առաջանա մի իրավիճակ, երբ նշանակվեն ՍԴ նոր դատավորներ, եւ զուգահեռ լինի երկու դատարան:

Մինչ այդ, Սահմանադրական դատարանում ներկայում յուրօրինակ իրավիճակ է առաջացել: Ազգային ժողովը նշանակել է ՍԴ նախագահի պաշտոնակատար, սակայն Ալվինա Գյուլումյանը, հղում անելով իր մասով իրողություններին, համարում է, որ ինքն է նախագահի պաշտոնակատարը: ՍԴ երեք անդամների լիազորությունների դադարեցման եւ երկու անդամների արձակուրդ մեկնելու պատճառով ներկայում քվորում չկա, եւ Դատարանը չի կարող նիստեր անցկացնել: Սա ՍԴ նոր ճգնաժա՞մ է, եւ ի՞նչ լուծում է այն ունենալու:

Եվ ընդհանրապես, պետության հիմնարար ինստիտուտի՝ Սահմանադրական դատարանի շուրջ այս ողջ պատմությունը ի՞նչ նստվածք ու հետեւանքներ է ունենալու:
