ԱԺ նախկին պատգամավոր Աբրահամ Մանուկյանի նկատմամբ հարուցված քրեական գործով կալանավորումը որպես խափանման միջոց ընտրելու միջոնորդությունը մակագրվել է Երևան քաղաքի ընդհանուր իրավասության դատարանի դատավոր Կարեն ֆարխոյանին:

ԼՈՒՐԵՐ.com-ի թղթակցի հետ զրույցում Աբրահամ Մանուկյանի փաստաբան Հրանտ Անանյանը հայտնեց, որ Մանուկյանի պաշտպանական թիմը ինքնաբացարկի միջնորդություն է հայտնել Կարեն Ֆարխոյանին, քանի որ այս գործի, այսպես ասած` մայր գործով դատավոր Կարեն ֆարխոյանի եղբայրը` Ջոն Ֆարխոյանը, մեղադրյալ է:

«Կարեն Ֆարխոյանի եղբայրը մինչ օրս նույն գործով մեղադրյալ է, գործը գտնվում է ԱԱԾ վարույթում, հետևաբար ինքն այս գործով չի կարող կաշկանդված չլինել, քանի որ սա շարքային գործ չէ: ԱԱԾ-ի միջնորդությունը մերժելը ցավոտ է լինելու ԱԱԾ-ի համար և, բնականաբար, դատավորը չի կարող չմտածել, որ այն կանդրադառնա իր եղբոր նկատմամբ բացասական վերաբերմունքով՝ ԱԱԾ-ի կողմից, քանի որ նույնացվելու է իր անձը եղբոր հետ: Հետևաբար, ողջամիտ կասկած է առաջանում, որ արդարադատության շահի տեսանկյունից ճիշտ չէ, որ ինքն այս գործով իրականացնի արդարադատություն կամ կալանավորման հարց քննարկի, մարդու ազատության սահմանափակման հետ կապված հարց լուծի: Մենք այս փաստարկներով հայտնել ենք ինքնաբացարկի վերաբերյալ միջնորդություն, բայց իր վերաբերմունքից ակնհայտ է` դատավորն ԱԱԾ-ի ցանկությամբ է ուզում գործն առաջ տանի, ինչն անթույլատրելի և անտրամաբանական է»,- ասաց փաստաբանը:
