Բիրտ ուժը հաղթեց. մենք գնում ենք պետական կառույցների կործանման, որը բերելու է պետության կործանման․ Իշխանյան

Հայաստանում բիրտ ուժը հաղթեց իրավական մտքին. մենք գնում ենք պետական կառույցների կործանման, որը բերելու է պետության կործանմանը։ Այս մասին այսօր՝ հունիսի 26-ին, Սահմանադրական դատարանի դիմաց լրագրողների հետ զրույցում ասաց «Հայաստանի Հելսինկյան կոմիտե» ՀԿ նախագահ, իրավապաշտպան Ավետիք Իշխանյանը։

«Այն, ինչը կատարվեց Սահմանադրական դատարանի հետ, ռուսերեն հայտնի արտահայտություն կա. «против лома нет приема»: Հայաստանում դա կատարվեց։ Բիրտ ուժը հաղթեց իրավական մտքին։ Եվ ցավոք սրտի, Հայաստանում այդ քաղաքական բիրտ ուժի դեմ պայքարի դուրս եկան ոչ թե քաղաքական ուժերը, այլ իրավաբաններ, որոշ դատավորներ, ՍԴ անդամներ եւ փաստաբաններ»,- ասաց Ավետիք Իշխանյանը։

Իրավապաշտպանի խոսքով՝ «ժողովրդավարություն», «լիբերալիզմ», «իրավական պետություն» գաղափարներ հռչակած քաղաքական ուժերը իրավական պետության կառուցման ճանապարհին անպաշտպան թողեցին իրավաբաններին, փաստաբաններին եւ մի քանի դատավորների։

«Ինչ կարող էին անել այդ իրավաբանները, ՍԴ դատավորները՝ միայն օրենքներով եւ իրավունքով պայքարելով բացարձակ մեծամասնություն կազմող, հլու հնազանդ իրեն ենթարկվող քաղաքական ուժի հետ, որին ենթարկվում են բոլոր ուժային կառույցները, քննչական մարմինները եւ ԱԱԾ-ն, որոնց հանձնարարելով նա հետապնդումներ է սկսում։ Նրանք պայքարեցին այնքան, որքան կարող էին առանց լուրջ աջակցության՝ ոչ քաղաքական ուժերի, ոչ հասարակության»,- ասաց նա։

Ավետիք Իշխանյանը չմեկնաբանեց ՍԴ դատավոր Վահե Գրիգորյանի հայտարարությունները՝ նշելով, որ նա իրավաբանական կրթություն ունի, բայց իրավաբան չէ․ «Նա քաղաքական գործիչ է եւ հլու-հնազանդ ենթարկվում է բռնապետի հակումներ ունեցող ղեկավարին։ Եվ նրա ասածները որեւէ հիմք չպետք է ծառայեն: Խորհրդային Միությունում բարձր մակարդակի իրավաբան կար՝ Վիշինսկի: Առանց մեկնաբանության»։

Հարցին, թե Հրայր Թովմասյանը քաղաքական, թե իրավական գործիչ է, Ավետիք Իշխանյանը պատասխանեց. «Հրայր Թովմասյանն իր գործունեությունը սկսեց քաղաքացիական հասարակությունից, հետո անցավ քաղաքականություն, հետո անցավ իրավաբանություն եւ վերջին իր գործունեությունը ցույց տվեց, որ նա քաղաքականությունից հեռացել է։ Այդպիսի դեպքեր էլ են լինում»,- նշեց նա։
