Գ. Ծառուկյանի փաստաբանի պատասխանը գլխավոր դատախազի մամուլի խոսնակի հայտարարությանը

Գլխավոր դատախազության մամուլի խոսնակ Գոռ Աբրահամյանը նշել է, թե իբրև Գագիկ Ծառուկյանի նկատմամբ կալանքը որպես խափանման միջոց ընրելու վերաբերյալ միջնորդության քննարկմանը զուգահեռ նրա պաշտպանները հանդես են գալիս ակնհայտ ապատեղեկատվությամբ ուղեկցվող հրապարակային հայտարարություններով՝ փորձելով իրողությունների, գործի հանգամանքների խեղաթյուրմամբ մոլորեցնել հանրությանը և ընթացող իրավական գործընթացին անհիմն կերպով այլ երանգներ հաղորդելու իրենց ընտրած ուղեգիծը պաշտպանել մանիպուլյատիվ պնդումներով:

Էս «մանիպուլյատիվ» բառը շատ հաճախ որպես հակափաստարկ օգտագործելն անլրջացնում է հայտարարությունը։
Սա ուղղակի ընկերական նկատառում, գուցե հաջորդիվ հաշվի առնվի։

Քանի որ չգիտեմ Գոռ Աբրահամյանն իրավաբան է, թե ոչ, ուստի իմաստ չեմ գտնում իրավական մասով հակադարձել, առավել ևս, որ այդքան ժամանակ չունեմ։ Էլ չեմ ասում, որ 2 օր դատարանում դա էինք անում, նիստն էլ ամբողջությամբ ձայնագրված է։
Կարծում եմ, որ այս գործերով դատախազությանը շատ է օգնում, որ կալանքի քննարկումը դռնփակ է։ Պատկերացնում եմ, թե ինչ կլիներ, եթե այն հրապարակային լիներ և բոլորն ականատես լինեին դրան։
Վստահ եմ, որ այդ մանիպուլյացիա բառի մասին չէին էլ հիշի ու միայն կմտածեին, թե այս խայտառակ վիճակից ոնց դուրս գան։

Իրավականի փոխարեն կարծում եմ, որ մամուլի խոսնակը գոնե 2 հարցի պատասխան պետք է տա հասարակությանը.
1. ինչպես է ստացվում, որ փետրվարի 5-ին հայտնաբերված փաստաթուղթը 4 ամիս հիմք չի հանդիսացել քրեական գործ հարուցելու համար, սակայն հունիսի 5-ին Ծառուկյանի կողմից կառավարությանը քննադատելուց անմիջապես հետո արդեն հիմք հանդիսացավ
(պատասխանի դեպքում առաջարկում եմ լավ պատրաստվել, քանզի այդ հարցը դատարանում մանրամասն քննարկել ենք և նիստին մասնակից խիստ պրոֆեսիոնալ 2 քննիչներն ու 3 դատախազները նույնիսկ մեծ ջանքերով չկարողացան պատասխանել՝ պատասխան չլինելու պատճառով)։
2. Ինչպես է ստացվում, որ վարչապետի մամուլի խոսնակը Ծառուկյանի հայտարարությունից անմիջապես հետո՝ հունիսի 5-ին արձագանքում է նրան և նշում, թե Ծառուկյանն անհանգիստ է մի շարք քրեական գործերի ընթացքով, որոնցից մեկը ընտրակաշառքի վերաբերյալ, եթե այդ պահի դրությամբ ընտրակաշառքի վերաբերյալ քրեական գործ չի եղել և այն հարուցվել է հենց այդ հայտարարությունից հետո՝ 4 ամիս առաջ ունեցած՝ վերը նշված փաստաթղթի հիման վրա։

Թե բա սա քաղաքական հետապնդում չէ, զուտ իրավական գործընթաց է։
Հուսամ՝ ժամանակ կունենամ դրա քաղաքական բնույթի վերաբերյալ մնացած ապացույցներն էլ ներկայացնել։

Եվ վերջում՝ պետք չէ անընդհատ պնդել, թե դատախազությունը միայն օրենքով է շարժվում և ձեր համար որևէ նշանակություն չունի, թե վարչապետը ինչ է ասում կամ ինչ հանձնարարություն է տալիս։ Չէ որ իրականում բոլորս էլ գիտենք, որ դա, մեղմ ասած, ճիշտ չէ։ Սակայն շատ վտանգավոր է, եթե հանկարծ կոնկրետ անձինք հավատան դրան։
Դա հղի է դատախազությանը վեթինգի ենթարկելու վտանգով։
