Տվեք Ձեր հրաժարականը, ազատեք Ձեզ այս քաոսից. Արթուր Գրիգորյանը՝ գլխավոր դատախազին

Քննարկում ենք մի
հարց, որը ինչքան էլ փորձ արվի մատուցել որպես իրավական գործընթաց, չի
ստացվելու։ Այս մասին այսօր՝ հունիսի 16-ին, ԱԺ-ի իր ելույթում ասաց ԲՀԿ
պատգամավոր Արթուր Գրիգորյանը։

«Որպես իրավաբան հայտարարում եմ՝ այս գործը իրավական հիմքեր չունի,
ապացուցողական թույլ բազա եւ կանխատեսում եմ, որ դժվար թե դատական վախճան
ունենա։ Ինչպես պարոն Ծառուկյանը նշեց օր ելույթում, չկա մի փաստ, հիմք, որ
Ծառուկյանը որեւէ մեկին գումար է տվել ընտրակաշառք բաժանելու համար։ Բայց
այս կարեւոր փաստի վրա աչք եք փակում, հասկանալի է՝ ինչու, չեք խորանում,
իսկ հիմա ամենակարեւորի մասին։ Եթե ասում եք իրավական ճանապարհ, իրավական
գործընթացներ, ապա պետք է իրավաբանորեն անխոցելի գործընթացով Ծառուկյանի
մեղադրանքը հաստատվի, նաեւ կալանքի հարց բարձրացվի։ Դուք արդեն իսկ խախտել
եք Դատախազության մասին ՀՀ օրենքի 7-րդ հոդվածի 1-ին մասը։ Ըստ այդ
հոդվածի՝ դատախազը ցանկացած հանգամանքներում պարտավոր է պահպանել քաղաքական
զսպվածություն եւ չեզոքություն։ Բայց Դուք այս օրենքի կոնկրետ հոդվածը
խախտել եք»,- ասաց նա։
Արթուր Գրիգորյանը պարզաբանեց, թե ինչ խախտման մասին է խոսքը. «Բացատրեմ՝ ինչպես։ Շատ խոսվեց
2018 թվականի ապրիլի իրադարձություններից, երբ Ազգային ժողով էիք մտել
Նիկոլ Փաշինյանին կալանավորելու միջնորդությամբ եւ հրաժարվեցիք այդ
միջնորդությունից՝ ավելի ուշ պարզաբանելով, որ Ձեզ հրաժարվելու հարցով
միջնորդել է Հայաստանի Հանրապետության փոխվարչապետը։ Ընդգծեմ՝ փոխվարչապետը
քաղաքական պաշտոն է։ Ի՞նչ է ստացվում՝ Դուք ենթարկվել եք քաղաքական
պաշտոնյայի քաղաքական ցանկություններին, քմահաճույքներին կամ
պարտադրանքներին եւ չեք ցուցաբերել Դատախազության մասին օրենքով ամրագրված
պարտադրանքը։ ՀՀ մեկ այլ օրենքի՝ Դատախազության մասին օրենքի 63-րդ հոդվածի
3-րդ մասի 2-րդ կետը սահմանում է՝ դատախազի լիազորությունները դադարում
են, եթե դատախազը կատարել է օրենքի կամ դատախազի վարքագծի կանոնների
խախտում։ Եւ այս հիմքով պահանջում եմ, պարոն Դավթյան, Ձեր հրաժարականը։
Դուք՝ որպես մասնագետ, որպես իրավաբան, անարառ չեք։ Քաղաքական պատվեր
կատարող դատախազը չի կարող որեւէ պատգամավորի, առավել եւս Գագիկ Ծառուկյանի
նման բարի համբավ ունեցող անձին մեղադրել գոյություն չունեցող փաստերի
հիման վրա։ Դուք ունեք եզրափակիչ ելույթի իրավունք, ափսոս եք, մոտեցեք այս
ամբիոնին, ես ժամանակին, անկեղծ եմ ասում, շատ եմ ուրախացել, երբ Դուք
նշանակվել եք գլխավոր դատախազ, տվեք Ձեր հրաժարականը, ազատեք Ձեզ այս
քաոսից»։
