Մենք հիմնավոր կասկածներ և փաստեր ունենք պնդելու, որ ՀՀ քաղաքացիներից թաքցվել է իրական պատկերը. Արթուր Ղազինյան

«Մեկ Հայաստան» կուսակցության հիմնադիր նախագահ Արթուր Ղազինյանը «Կենտրոն» հեռուստաընկերության «Իմպուլս» հաղորդաշարի հյուրն էր, որի ընթացքում խոսել է կորոնավիրուսի դեմ պայքարը տապալելու փաստով ՀՀ գլխավոր դատախազություն քրեական գործ հարուցելու միջնորդություն ներկայացնելու և երկրում տիրող աղետալի վիճակի մասին:

Իրականում իսկական ժամանակն է քրեաիրավական գնահատական տալ պետության պատկան մարմինների և պատասխանատու անձանց գործողություններին, քանի որ արդեն 4 ամիս է, ինչ հասարակությունը պայքարում է՝ իրականում հասարակությունն է պայքարում կորոնավիրուսի դեմ, այլ ոչ թե իշխանությունը և արդեն արձանագրված է ավելի քան 300–ից ավել մարդկային կյանքերի ընդհատումներ: Ճիշտն ասած, ոչ թե մենք պետք է դիմեինք դատախազություն, այլ հենց դատախազն ինքը պետք է քրեական գործ հարուցեր:

Սա նորմալ և իրավական պետության իրավապահ մարմինների պատասխանատու աշխատանքն է հուշում, որ նման իրավիճակներում հարուցվում են քրեական գործեր՝ պարզելու համար արդյոք պետական պատասխանատու պաշտոնյաները, պատկան մարմինները գործել են ժամանակին իրավիճակին համարժեք, ձեռք են առել բոլոր անհրաժեշտ միջոցները կանխելու համավարակի տարածումը, փրկելու մարդկային կյանքերը: Եթե դատախազությունը չի դիմում քրեական գործ հարուցելու, ապա արդեն մենք ենք ստիպված լինում հուշել և պահանջել, որպեսզի քրեական գործ հարուցվի, այստեղ գերակա է իրավունքի գերակայության հարցը և օրենքի առջև բոլորի հավասարության հարցը:

Մենք նշել ենք, թե քրեական օրենսգրքի, որ հոդվածների հատկանիշներով է հանցակազմը համապատասխանում գործողություններին: Ես թվարկեմ ընդամենը 2 հոդված, առաջինը ՔՕ-ի 278-րդ հոդվածն է, որտեղ մարդու կյանքի և առողջության համար կենսական վտանգ ներակայացնող տեղեկատվությունը թաքցնելը կամ աղավաղելը տվյալ տեղեկատվությունը տրամադրելու պարտավորություն ունեցող սուբյեկտի կողմից և դրա 2-րդ մասով, եթե դա կատարել է ոլորտի համար պատասխանատու սուբյեկտը, որը հանգեցրել է մահվան կամ առողջության վնասման:

Մի հետաքրքիր բան ասեմ, տեղեկատվության թաքցնելը կամ աղավաղելն արդեն իսկ քրեական հանցակազմ է պարունակում կոնկրետ ոլորտի համար պատասխանատու սուբյեկտների և նման տեղեկատվություն տրամադրելու պարտավորություն ունեցող պատասխանատուների համար:

Մենք հիմնավոր կասկածներ ունենք, նաև ունենք փաստեր պնդելու, որ Հայաստանի Հանրապետության քաղաքացիներից թաքցվել է իրական պատկերը, իրական տվյալները և նախաքննությունը պետք է հետամուտ լինի պարզելու հասարակությանը հուզող հարցերի պատասխանների առնչությամբ և ,մեղավոր անձանց պատասխանատվության ենթարկելու:

Չէ՞ որ մեր քաղաքացիների կյանքը բարձրագույն արժեք է և այսօր մենք արդեն ունեք 327 մահ: Եթե ձեռնարկվեին բոլոր միջոցառումները եթե պետությունը իրավիճակին համարժեք գործեր, արդյո՞ք այդ մարդիկ կմահանային: Ավելի քան համոզված եմ, որ հնարավոր էր փրկել մարդկային կյանքերը:
