Սահմանադրական փոփոխությունների հանրաքվեն չի կարող Ազգային ժողովի որոշմամբ չեղարկվել, դա ակնհայտ հակասահմանդրական օրենք է: Այս մասին Tert.am-ի հետ զրույցում ասաց արդարադատության նախկին նախարար Դավիթ Հարությունյանը՝ անդրադառնալով երեկ Ազգային ժողովում քննարկված «Հանրաքվեի մասին» օրենքում փոփոխություններ կատարելու մասին նախագծին:

Ինչ վերաբերում է ՍԴ հարցը ԱԺ միջոցով լուծելու համար իշխող ուժի՝ Վենետիկի հանձնաժողով դիմելուն, Դավիթ Հարությունյանն ասաց. «Ինձ համար անհասկանալի է այդ օրենքի նախագծի քննարկումն այն պարագայում, երբ Վենետիկի հանձնաժողովից չեն ստացել որևէ արձագանք: Ավելին, բոլորն էլ տեղյակ են, որ արձագանքը ստացվելու է հունիսի 20-ի Վենետիկի հանձնաժողովի նիստում, իսկ այն, ինչ ծրագրում է խորհրդարանական մեծամասնությունը, նախագծի քննարկումը և քվեարկությունն է մինչ այդ: Ինձ համար բացարձակապես անհասկանալի գործընթաց է, կարծում եմ՝ ինչ-որ մի իրադարձություն է տեղի ունեցել, կամ ինչ-որ ինֆորմացիա է ստացել իշխող մեծամասնությունը, որ սկսել է այսքան հրատապ տանել մի նախագիծ, որի վերաբերյալ կարծիք է հարցրել Վենետիկի հանձնաժողովից»:

Հարությունյանի կարծիքով՝ իշխող ուժը ՍԴ հարցը նորից բերել է օրակարգ միայն մեկ բանի համար՝ ունենալ հլու, հազանդ ՍԴ: «Իշխանության համար «իդեա ֆիքս» է դարձել ունենալ հլու- հնազանդ Սահմանադրական դատարան, և բոլոր քայլերը ձեռնարկվում են այդ ուղղությամբ. հիշենք քրեական հետապնդումները Հրայր Թովմասյանի մերձավորների նկատմամբ, քրեական հետապնդումը Հրայր Թովմասյանի նկատմամբ, ՍԴ դատավորներին կաշառելու փորձը, ապա՝ հանրաքվեն, սրանք բոլորը մեկ խնդրի լուծման են ուղղված՝ ունենալ հլու- հնազանդ Սահամանդրական դատարան»,- ընդգծեց նա:

Հարությունյանի կարծիքով՝ ակնհայտ է, որ հանրաքվեի արդյունքների հետ կապված մտավախություն ունի իշխող ուժը և հիմա այս նախագիծը բերելու պատճառը դա է:

Իսկ թե ինչու հանրաքվե անցկացնելու որոշումը կայացնելուց իշխանությունը չդիմեց Վենետիկի հանձնաժողովին, թեև քննադատությունների պակաս չկար, Հարությունյանն արձագանքեց. «Ինձ դժվար է գնահատել նրանց անտրամաբանական քայլերը»:

Հիշեցնենք, որ նախագիծը ԱԺ-ին հնարավորություն է տալիս չեղարկել իր իսկ կողմից կայացրած հանրաքվեի անցկացման որոշումը:
