ՄԻՊ-ը՝ Կապանում ծավալվող իրադարձությունների մասին

Այսօր առավոտյան Մարդու իրավունքների պաշտպանի աշխատակազմի թեժ գծին ահազանգեր են ներկայացրել երկու փաստաբան, ովքեր նշել են, որ Ոստիկանության Կապանի բաժին են բերման ենթարկվել իրենց 3 վստահորդները, իրենք այցելել են Ոստիկանության բաժին, սակայն Ոստիկանները թույլ չեն տվել մուտք գործել բաժին և տեսակցել իրենց վստահորդներին: Այս ահազանգերից քիչ անց փաստաբանները կրկին տեղեկացրել են, որ արգելանքի վերացված անձանցից երկուսն արդեն գտնվում են քննչական մարմնում:

Փաստաբանների ահազանգերից հետո Մարդու իրավունքների պաշտպանի աշխատակազմի թեժ գծին են զանգել Քաջարանի բնակիչներ և տեղեկացրել, որ առավոտյան Ոստիկանության Կապանի բաժին բերման ենթարկված անձանցից մեկի մտերիմներն են, ով ազատ է արձակվել և գտնվում է իրենց մոտ: Ըստ Քաջարանի բնակիչների ահազանգի՝ բերման ենթարկված և ազատ արձակված անձի վրա առա են մարմնական վնասվածքներ, Ոստիկանությունը նրա նկատմամբ ֆիզիկական բռնություն է գործադրել ինչպես տանից բերման ենթարկելու ընթացքում, այնպես էլ Ոստիկանության բաժնում, ինչպես նաև նրա հասցեին արվել են արժանապատվությունը նվաստացնող արտահայտություններ: Ըստ ահազանգի՝ նա ներկայում հետազոտություն է անցնում բժշկական հաստատությունում: Մարդու իրավունքների պաշտպանի աշխատակազմ են ուղարկվել լուսանկարներ, որոնք քաղաքացիների պնդմամբ՝ վկայում են բռնության փաստի մասին:

Մենք մանրամասն ուսումնասիրել ենք նաև բոլոր հրապարակային տվյալները, այդ թվում՝ լուսանկարները:

Ահազանգերից անմիջապես հետո Մարդու իրավունքների պաշտպանի աշխատակազմի թե ՛ կենտրոնական մարմինը, թե՛ Սյունիքի մարզային ստորաբաժանումը նախաձեռնել են անհրաժեշտ քայլեր: Աշխատանքներ են տարվել Ոստիկանության և քննչական մարմինների հետ: Կապի մեջ ենք փաստաբանների ու ահազանգ ներկայացրած քաղաքացիների հետ: Արդեն իսկ աշխատում է մեր Կապանի ստորաբաժանումը և փաստաբանները կամ քաղաքացիները կարող են ստանալ լիարժեք աջակցություն:

Մարդու իրավունքների պաշտպանի աշխատակազմի պարզած նախնական տվյալով այս գործով առկա է ևս մեկ անձ, որ բերման ենթարկվել և ձերբակալվել է Երևանում: Այս անձի հարցով մենք կապի մեջ կլինենք քննչական մարմնի հետ:

Նկարագրված տվյալների կապակցությամբ պետք է անմիջապես նախաձեռնվի քրեական գործ։ Ընդ որում, ստուգողական բոլոր գործողությունները պետք է կատարվեն բացառապես ՀՀ քրեական դատավարության օրենսգրքով նախատեսված ընթացակարգի շրջանակում։ Այսպիսի դեպքերում ծառայողական քննությունը չի կարող փոխարինել քրեական վարույթին ու չի կարող լինել նման տվյալների ստուգման ընդունելի ձև:

Վաղն առավոտյան իմ ստորագրությամբ համապատասխան պաշտոնական գրություն կուղարկվի Դատախազություն և Ոստիկանություն։ Փաստաբանները նշել են, որ ահազանգից բացի, Մարդու իրավունքների պաշտպանին առավոտյան կներկայացնեն լրացուցիչ գրավոր բողոք, ինչը նույնպես հաշվի կառնվի մեր գրավոր պահանջները կազմելիս:

Ընթացքը Մարդու իրավունքների պաշտպանի իրավասության առավելագույն սահմաններում կլինի իմ ուշադրության ներքո։
