Հրայր Թովմասյանին գահընկեց կանեն առաջին փուլով. «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է. Սահմանադրական դատարանի ճգնաժամի լուծման ուղիներից մեկը երեկ «Ազատության» եթերում ներկայացրել է ՀՀ արտաքին հարաբերությունների նախագահ Ռուբեն Ռուբինյանը: Եվ եթե այն կյանքի կոչվի, ստացվում է՝ իշխանությունները հրաժարվում են իրենց նախնական ծրագրից: Ինչպես հայտնի է, ապրիլի 5-ին տեղի ունենալիք սահմանադրական փոփոխությունների հանրաքվեի ընդունման պարագայում պետք է իրենց պաշտոններին հրաժեշտ տային Սահմանադրական դատարանի 9 անդամներից 7-ը՝ Հրայր Թովմասյանը (նախագահ), Ալվինիա Գյուլումյանը (փոխնախագահ), Ֆելիքս Թոխյանը, Արայիկ Թունյանը, Աշոտ Խաչատրյանը, Հրանտ Նազարյանը, Արեւիկ Պետրոսյանը: Սակայն նոր տարբերակի իրագործման պարագայում ոչ բոլոր դատավորներն են, այսպես ասած, տուն ուղարկվելու: «Սահմանադրական դատարանի այն դատավորները, որոնք պաշտոնավարել են 12 տարուց ավելի, կդադարեն պաշտոնավարել», – նշել էր Ռուբինյանը: Այսինքն՝ Ռուբինյանի արտահայտած տարբերակից պարզ է դառնում, որ Հրայր Թովմասյանը շարունակելու է մնալ ՍԴ անդամ, իսկ այդ պաշտոնին հրաժեշտ կտան միայն երկուսը: Բայց նկատենք, որ Հրայր Թովմասյանը միայն կդադարի լինել Սահմանադրական դատարանի նախագահ, քանի որ ընտրվել է ոչ թե վեց տարով, այլ մինչեւ թոշակի անցնելը, սակայն կմնա շարքային դատավոր: Հրայր Թովմասյանը դատավոր էր ընտրվել 2018-ին՝ մարտի 2-ին: Վահե Գրիգորյանը եւ Արման Դիլանյանն իրենց պաշտոններում նշանակվել են 2018 թ. հեղափոխությունից հետո՝ 2015 թ. ընդունված նոր կարգով: Մյուս յոթ դատավորները ՍԴ անդամ են դարձել նախկին կարգով, սակայն նրանցից միայն երկու դատավոր՝ Հրանտ Նազարյանն ու Ֆելիքս Թոխյանը կդադարեն լինել ՍԴ անդամներ, քանի որ նրանք պաշտոնավարում են 12 տարուց ավելի, իսկ, ահա, Արեւիկ Պետրոսյանն ու Աշոտ Խաչատրյանն էլ կշարունակեն պաշտոնավարել եւս 1-2 տարի: Այսինքն՝ վեթթինգի օրինակով իշխանությունները որոշել են մաս-մաս լուծել Սահմանադրական դատարանի հարցը, եւ առաջին փուլում այս երկու դատավորները հրաժեշտ կտան իրենց պաշտոնին, հետո եւս երկուսը, եւ այդպես շարունակ: Այսպիսով, իշխանությունները հնարավորություն են ունենում «գահընկեց» անել Հրայր Թովմասյանին ՍԴ նախագահի պաշտոնից` նրան թողնել որպես ՍԴ շարքային անդամ: Սակայն «Ժողովուրդ» օրաթերթի տեղեկություններով՝ իշխանության ներսում այս հարցով բուռն քննարկումներ են, ոչ բոլորն են կողմ այս տարբերակին եւ արդեն հայտնել են իրենց անհամաձայնությունը: Մենք տեղեկացանք, որ, ամեն դեպքում, սա նախնական տարբերակներից մեկն է, եւ չի բացառվում, որ Վենետիկի հանձնաժողովի պատասխանը ստանալուց հետո փոփոխություններ լինեն նաեւ լուծման այս տարբերակում: Ամեն դեպքում, մենք հայտնել էինք, որ երկու փուլ է լինելու՝ հարցը խորհրդարանում լուծելու համար: Որոշումներից մեկով պետք է հետ կանչվի հանրաքվեի նախագիծը, ապա արդեն քվեարկության դրվի նոր նախագիծ, որը կլուծի ՍԴ հարցը:
