Պարետ Ավինյանը հաստատել է ծանուցագրի ձևը և բովանդակությունը

Պարետ Տիգրան Ավինյանը նոր որոշում է ստորագրել, որով սահմանել է ինքնամեկուսացման ենթակա անձանց ինքնամեկուսացումը կազմակերպելու կանոնները և ծանուցագրի ձևը, որը պետք է տրամադրվի արտերկրից ժամանած քաղաքացիներին։

ԾԱՆՈՒՑԱԳԻՐ

Ինքնամեկուսացման կամ մեկուսացման կանոնները խախտելու համար նախատեսված պատասխանատվության վերաբերյալ Դուք ծանուցվում եք, որ ինքնամեկուսացման կամ մեկուսացման կանոնները խախտելը առաջացնում է ՀՀ քրեական կամ Վարչական իրավախախտումների վերաբերյալ օրենսգրքերով նախատեսված պատասխանատվություն:

ՀՀ քրեական օրենսգրքի 277.1 հոդվածի և Վարչական իրավախախտումների վերաբերյալ օրենսգրքի 182.3-րդ հոդվածի 10-րդ մասի համաձայն՝ Մեկուսացում է համարվում անձանց, այդ թվում` հիվանդի կամ վարակվածի կամ նրանց հետ շփված անձանց (կոնտակտավորների) առանձնացումը դրա համար նախատեսված որոշակի տարածքում՝ այլ անձանց հետ անմիջական շփումը բացառելու և վարակի տարածումը կանխելու նպատակով:

Ինքնամեկուսացում է համարվում անձանց, այդ թվում` հիվանդի կամ վարակվածի կամ նրանց հետ շփված անձանց (կոնտակտավորների) առանձնացումն իրենց մշտական բնակության կամ իր նախընտրությամբ մեկ այլ վայրում՝ այլ անձանց հետ անմիջական շփումը սահմանափակելու և վարակի տարածումը կանխելու նպատակով:

ՀՀ քրեական օրենսգրքի 277.1 հոդվածի համաձայն՝ Արտակարգ իրավիճակի հիմքով հայտարարված արտակարգ դրության ընթացքում մեկուսացման կամ ինքնամեկուսացման կանոնները կամ ազատ տեղաշարժվելու իրավունքի այլ սահմանափակումները խախտելը՝ պայմանավորված առաջացրած հետևանքներից (օրինակ՝ մեկ կամ մի քանի անձի վարակում, վարակելու արդյունքում մարդու առողջությանը ծանր վնասի պատճառում կամ մարդու մահ)։

Կարող է պատժվել.

տուգանքով՝ առավելագույնը 700.000 ՀՀ դրամի չափով,
կալանքով՝ առավելագույնը 3 ամիս ժամկետով,
ազատազրկմամբ՝ առավելագույնը 4 տարի ժամկետով,
կալանքը և ազատազրկումն ուղեկցվում են որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը երեք տարի ժամկետով:
Վարչական իրավախախտումների վերաբերյալ օրենսգրքի 182.3-րդ հոդվածի 10-րդ մասի համաձայն՝ Արտակարգ իրավիճակի հիմքով հայտարարված արտակարգ դրության ընթացքում որպես սահմանափակում նախատեսված մեկուսացման կամ ինքնամեկուսացման կանոնները կամ ազատ տեղաշարժվելու իրավունքի այլ սահմանափակումները խախտելը՝

առաջացնում է տուգանքի նշանակում՝ 100.000-250.000 ՀՀ դրամի չափով։
Ինքնամեկուսացման ռեժիմի խախտման դեպքում ինքնամեկուսացումը կարող է փոխարինվել մեկուսացմամբ՝ դրա համար նախատեսված որոշակի տարածքում:

ՀՀ սահմանը հատող անձինք պատասխանատվություն են կրում նաև իրենց հետ ժամանող մինչև 16 տարեկան անչափահաս անձանց կողմից ինքնամեկուսացման կանոնները չպահպանելու նամար։
