Ապօրինի անտառահատում իրականացնողներին չտուգանելով՝ հայտնվել է դատարանում. «Փաստ»

«Փաստ» օրաթերթը գրում է.

«Հայանտառ» ՊՈԱԿ «Գուգարքի անտառտնտեսություն» մասնաճյուղի Խնձորուտի անտառպետության անտառապետին մեղադրանք է առաջադրվել` պաշտոնական լիազորությունները չարաշահելու համար:
Լոռու մարզային քննչական վարչությունում կատարված քննությամբ պարզվել է, որ «Հայանտառ» ՊՈԱԿ «Գուգարքի անտառտնտեսություն» մասնաճյուղի Խնձորուտի անտառպետության անտառապետի ժամանակավոր պաշտոնակատար Սպարտակ Կռոյանը, որ ի պաշտոնե պարտավոր է եղել անմիջականորեն իրականացնել անտառպետության ղեկավարումը, ի թիվս այլ գործառույթների՝ հսկել տարածքում իրականացվող աշխատանքները, կանխարգելել, հայտնաբերել և օրենքով սահմանված կարգով ընթացք տալ ՀՀ անտառային օրենսդրության խախտումներին։
ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնի հաղորդմամբ` 2015 թ. դեկտեմբերի կեսերին անտառպետության 7–րդ պահաբաժնի «Ռուդնիկ» կոչվող տեղամասում անտառապետը նկատել է, որ Լերմոնտովո գյուղի 3 բնակիչներ բենզասղոցներով և կացիններով ապօրինի հատել են տարբեր տրամագծերով ուռի, բոխի, թխկի, հաճար, կեչի, ՀՀ «Բույսերի Կարմիր գրքում» գրանցված արոսենի հայաստանյան տեսակի ծառեր և ճյուղեր, մասնատել են դրանք և պատրաստել՝ անտառից դուրս բերելու համար, սակայն ոչինչ չի ձեռնարկել՝ արձանագրված անտառախախտումներին օրենքով սահմանված կարգով ընթացք տալու համար։
Ինչպես տեղեկանում ենք Հայաստանի Դատական տեղեկատվական համակարգից՝ անտառահատողների հետ ունեցած բարիդրացիական հարաբերությունները պահպանելու անձնական շահագրգռվածությունից ելնելով, Սպարտակ Կռոյանն իր ծառայողական պարտականությունները չի կատարել՝ չի արձանագրել և սահմանված կարգով ընթացք չի տվել հիշյալ անտառխախտմանը, որը պետության օրինական շահերին պատճառել է էական՝ 375 հազար 810 դրամի չափով գույքային վնաս:
Այս գործի վերաբերյալ առաջին դատական նիստը կայացել է փետրվարի 8–ին: Վերջինիս նկատմամբ որպես խափանման միջոց է կիրառվել չհեռանալու մասին ստորագրությունը:
Ձեռք բերված ապացույցների համակցությամբ՝ անտառապետին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 308–րդ հոդվածի 1–ին մասով (պաշտոնական լիազորությունները չարաշահելը): Այն պատժվում է տուգանքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից երեքհարյուրապատիկի չափով կամ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը հինգ տարի ժամկետով, կամ կալանքով՝ երկուսից երեք ամիս ժամկետով, կամ ազատազրկմամբ՝ առավելագույնը չորս տարի ժամկետով:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
