Սուրիկ Խաչատրյանի առանձնատան կառուցման հանգամանքների վերաբերյալ «Հետք»- ի հրապարակման առթիվ քրեական գործ է հարուցվել

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ուսումնասիրվել են «Հետք» էլեկտրոնային թերթում 2018թ. օգոստոսի 24-ին հրապարակված «Սուրիկ Խաչատրյանն իր առանձնատունը 8 տարի կառուցել է առանց շինթույլտվության» վերտառությամբ հրապարակման մեջ նշված հանգամանքները: Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ գլխավոր դատախազության հանրային կապերի բաժնից, այդ նպատակով Երևանի քաղաքապետարանից և ՀՀ անշարժ գույքի կադաստրի կոմիտեից պահանջել էին անհրաժեշտ փաստաթղթեր և համապատասխան տեղեկատվություն:

Իրականացված ուսումնասիրությունների արդյունքում պարզվել է, որ Երևանի քաղաքապետարանի պաշտոնատար անձինք չեն կատարել «Քաղաքաշինության մասին» ՀՀ օրենքով սահմանված ծառայողական պարտականությունները՝ չեն նախազգուշացրել կառուցապատողին նշված առանձնատան շինարարության թույլտվությամբ սահմանված ժամկետը երկարաձգելու և այդ ժամկետում կառուցապատումն ավարտելու կամ քաղաքաշինական գործունեության օբյեկտն օտարելու վերաբերյալ:

Դրա հետևանքով բացառվել է 357 մլն դրամ նախահաշվային արժեք ունեցող շինության կառուցապատողին օրենքով սահմանված կարգով դրա մեկ տոկոսի, այն է՝ 3.570.870 դրամի չափով վարչական պատասխանատվության ենթարկելու հնարավորությունը՝ համայնքին պատճառելով նույնքան դրամի նյութական վնաս:

Հիշյալ դեպքի առթիվ ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչության ավագ դատախազի կողմից ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի (պաշտոնատար անձի կողմից շահադիտական, անձնական այլ շահագրգռությունից ելնելով ծառայողական պարտականությունները չկատարելու) հատկանիշներով հարուցվել է քրեական գործ, որի նախաքննության կատարումը հանձնարարվել է ՀՀ քննչական կոմիտեի քննիչին:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
