Քրեական գործ՝ կառուցված կոպիտ օրինախախտումների և կեղծիքների վրա

Ասանետ Լալայանը ֆեյսբուքյան իր էջում գրում է.

«Բազմակի հարվածների արդյունքում ստացած ուղեղի ցնցում, կողոսկրի կոտրված, ծակված թոք, սալջարդեր և այլ մարմնական վնասվածքներ. նման դատաբժկական եզրակացության մասին լսելով, արդեն կարելի է ենթադրել, որ այս ամենից տուժողը կամ կոմայի մեջ է գտնվում, կամ էլ առնվազն հայտնվել է վերակենդանացման բաժանմունքում ու դեռ երկար կմնա այնտեղ՝ ծայրահեղ ծանր վիճակում:

Նման եզրակացության հիման վրա մեկ ամսից ավել է կալանքի մեջ է գտնվում Էդուարդ Բաբայանը: Սակայն իրականում նման դատաբժշկական եզրակացությամբ մարդը ոչ միայն կոմայի մեջ չէ կամ ծանր վիճակում, այլև հիվանդանոցից իր իսկ ստորագրությամբ դուրս է գրվում դեպքի երկրորդ իսկ օրը, ու շտապում է տեղի ունեցածի մասին հարցազրույցներ տալ լրագրողներին, ինչպես նաև ժամերով սպասել դատարանի դռան մոտ, որպեսզի այդ ամենը ներկայացնի նաև իրավապահներին:

Հարությունովի այս վիճակը արձանագրված է փաստերով՝ տեսանյութերով ու բազմաթիվ ականատեսներով: Այս ամենը հաստատում են, որ նրա դեմքին կապտուկ կամ քերծվածքի նշույլ անգամ չի եղել, ուր մնաց թե վերոնշյալ վնասվածքները:

Եվ ուրեմն ինչո՞ւ է կազմվել նման դատակբժշկական եզրակացություն, և կգտնվի՞ արդյոք աշխարհում մի մասնագետ, ով կհամաձայնի, որ նման վնասվածքներով մարդը կարող էր երկրորդ օրը դուրս գրվել հիվանդանոցից, ազատ շարժել թևերը, բարձր ձայնով խոսել, ժամերով մնալ ոտքի վրա և այլն: Վստահ ենք՝ ոչ, ինչպես նաև համոզված ենք, որ բժշկական կրթություն էլ պարտադիր չէ ունենալ, այս ամենը հասկանալու համար:

Ստացվում է, որ այս գործում կա ոչ միայն կանխակալ վերաբերմունք, այլև համակարգի աշխատակիցներն ունեն հովանավորներ ու պատվիրատուներ: Չէինք ցանկանա նոր կերտվող Հայաստանում ևս խոսել այսպիսի արատավոր երևույթների գոյության մասին, բայց վերոնշյալ քրեական գործի մանրամասները ուսումնասիրելով, համոզվում ենք, որ ցավոք դա այդպես է:

Բավական է միայն շեշտել այն հանգամանքը, որ Հարությունը մամլո ասուլիսի ժամանակ բացահայտ կերպով հայտարարեց, որ քննչական մարմնում իրենից փորձել են բառիս բուն իմաստով կորզել իրենց ցանկալի ցուցմունքը ու դրան հասնելու համար դիմել են շանտաժի ու սպառնալիքի հին մեթոդին: Ի վերջո արդեն երկրոդ ամիսն է, ինչ Հարությունովը հարցաքննությունների ու հարզացրույցների ժամանակ համառորեն պնդում է, որ եղելությունն այն չէ, որը ներկայացվում է, որ չարաբաստիկ բժշկական եզարակացությունը կեղծ է ու ոտնահարվում են իր իրավունքները:
Այս ամենի մեջ գործուն մասնակցություն ունեցող անձինք երևի չեն գիտակցում, որ երկրում իսկապես իրավիճակ է փոխվել ու իրենց տեսակն ու գործելաոճը մեր երկրում այլևս տեղ չունեն:

Հետևաբար՝ այս գործի առնչությամբ կեղծ դատաբժշկական եզրակացութուն տվողները, ինչպես նաև քննչկան մարմնում հոգեբանական ճնշումներ ու սպառնալիքներ գործադրած բոլոր անձինք, այդ թվում նաև նրանց պատվիրատուներն ու հովանավորյալները չպետք է տեղ ունենան նոր Հայաստանում, ավելին՝ պետք է կրեն իրենց պատիժը՝ օրենքի ողջ խստությամբ:
