Որոշ օղակներ ջանք ու եռանդ չեն խնայում առկա փաստերը կեղծելու համար

Դավիթ Սեդրակյանը ֆեյսբուքյան իր էջում գրում է.

Մեկ ամսից ավել է, ինչ ԲՀԿ նախագահ Գագիկ Ծառուկյանի թիկնազորի պետը՝ Էդուարդ Բաբայանը գտնվում է կալանքի տակ։ Կալանավորման որոշումը ի սկզբանե եղել է առանց հիմքի, քանի որ ենթադրյալ տուժող Վյաչեսլավ Հարությունովի կողմից չի տրվել որևէ ցուցմունք, ավելին Հարությունովը լրագրողներին տված հարցազրույցներում բազմիցս նշել է, որ Էդուարդ Բաբայանը իր հետ պատահած դեպքի հետ կապ չունի և որ ինքը գտնվում է լիարժեք առողջ վիճակում։

Չնայած Հարությունովի պնդումների ու Բաբայանի անմեղության վարկածն ապացուցող փաստերի՝ դատաբժշկական փորձաքննությունն այլ բան է ասում։

Ըստ այդ փորձաքննության՝ Վյաչեսլավ Հարությունովի մոտ առկա են ծանր մարմնական վնասվացքներ , ծակված թոք, սալջարդեր, ուղեղի ցնցում, նույնիսկ կողոսկրի կոտրվածք ։ Կարդալով այս «չափազանց անաչառ» փորձաքննության արդյունքները, միանգամից հարց է առաջանում թե ինչպես է Հարությունովը նման ծանր վնասվածքներով հիվանդանոցից դուրս գրվել հենց դեպքի երկրորդ օրը։

Համացանցում առկա բազմաթիվ տեսանյութերում, որտեղ Հարությունովը հարցազրույցներ է տալիս՝ պարզ է դառնում, որ դատաբժշկական փորձաքննության արդյունքները շինծու են և Հարությունովը գտնվում է բացարձակ առողջ վիճակում։

Անհանգիստ շարժումներով Հարությունովը, ով «ծակված թոքերով» ու զիլ ձայնով հարցազրույց էր տալիս լրագրողներին, պարզվում է ՝ ժամերով դատարանում սպասել է, ազատ շարժել ձեռքերը, զրուցել լրագրողների հետ, և իրեն պահել այնպես , ինչպես ցանկացած առողջ մարդ։ Նշված փաստերից պարզ է դառնում մի բան, կան որոշ օղակներ, ովքեր ջանք ու եռանդ չեն խնայում առկա փաստերը կեղծելու, անմեղության կանխավարկածը խախտելու համար։ Ցանկացած միջնորդություն, որն արվում է Բաբայանին ազատ արձակելու համար, առանց որևէ հիմքի անմիջապես մերժվում է դատարանի կողմից ։

Այսքանից պարզ է դառնում, որ Հայաստանի իրավապահ համակարգը դեռ շատ անելիքներ ունի, քանի որ դեռ անպատիժ է այն դատաբժիշկը, ով ակնհայտ կեղծ արդյունքներ է հրապարակել։ Այնինչ հանրությունը պետք է իմանա կեղծ եզրակացություն տված դատաբժիշկին և պահանջի նրան ենթարկել խիստ պատասպանատվության՝ օրենքով սահմանված կարգով: Արդարադատությունը Հայաստանում չի կարող իրականացվել կեղծ դատաբժշկական եզրակացությունների հիման վրա:
