Դատական համակարգը դեռ հեռու է անկախ լինելուց

Գարիկ Գասպարյանը ֆեյսբուքյան իր էջում գրում է.

Այսօր Երևանի ընդհանուր իրավասության դատարանը մերժեց ազատ արձակել ԲՀԿ նախագահ Գագիկ Ծառուկյանի օգնական Էդուարդ Բաբայանին։ Հիշեցնենք, որ Բաբայանին ձերբակալելու պատճառ էր դարձել ոմն Վյաչեսլավ Հարությունովի հայտարարությունը ծեծի ենթարկվելու մասին, որը հետո հերքել էր Հարությունովի կինը, իսկ քիչ անց նաև ինքը՝ Հարությունովը։

Նենք, որ այս պահին ոչ մի բողոք չկա Էդուրադ Բաբայանի մասով, չկա ոչ մի դատաբժշկական փորձաքնոության արդյոք, որ եղել է ծեծկռտուք, կա միայն արդեն հերքված բանավոր մեղադրանքներ։ Եվ միայն դրա հիման վրա եղել է ձերբակալության ոչ իրավաչափ որոշում։

Բացի այդ այսօր դատարանի կողմից որոշման կայացման գործընթացը, որի համար պահանջվում էր ընդամնեը 1 ժամ, տևել է ավելի քան 7 ժամ, ինչից հստակ զգացվել է, որ դատարանը սպասում է ինչ-որ ցուցումների։ 1 ժամ տևող գործընթացը 7 անգամ երկարացնելը, իսկ վերջում ոչ իրավաչափ կերպով ձերբակալված անձին ազատելուն բացասական եզրակացություն տալը, արդեն իսկ լուրջ կասկածներ է հարոցում, որ նոր Հայաստանում դատական համակարգը իսկապես անկախ է։

Սա ևս մեկ անգամ հիքմ է տալիս եզրակացնելու, որ այս ամենի հիմքում կան քաղաքական դրդապատճառներ, որոնք փորձ է արվում լուծել իրավական մեթոդներով։
