Քաղաքական մրցակցությունը չպետք է դառնա մարդուն ապօրինի ձերբակալելու պատճառ

Դավիթ Բերբերյանը ֆեյսբուքյան իր էջում գրում է.

Երեկ ոմն Վյաչելսավ Հարությունովի հնչեցրած մեղադարքների հիման վրա անհիմն կերպով ձերբակալվել է ՀԱՕԿ նախագահ Գագիկ Ծառուկյանի օգնական Էդուարդ Բաբայանը: Եվ մինչ շատերը բարձրաձայնում են այս ձերբակալության ոչ իրավաչափ լինելը, քանի որ չկա դատաբժշկական փորձաքննության եզրակացություն, իսկ Հարությունովը ժամեր անց հերքել է իր ցուցմունքները, որոշ ուժեր փորձում են անհիմն կերպով քաղաքականացնել այս իրադարձությունները:

Կան ուժեր իրենց սպասարկող լրատվամիջոցներով, ովքեր ամիսներ շարունակ սպասել են նման թեմայի, որպեսզի անմիջապես կառչեն դրանից: Երեկ այդ լրատվամիջոցները ամբողջությամբ մատնեցին իրենց, քանի որ այն ուղղորդված քաղաքական շահարկումները, որը նրանք տանում էին, ցույց էր տալիս, որ նրանք աշխատում են հրահանգով:

Ոմանք այնքան ոգևորվեցին, որ անգամ սկսեցին խոսել Ծառուկյանի՝ կրկին քաղաքականությունից հեռանալու մասին, ինչը պարզապես ծիծաղելի էր: Դա նաև մատնեց նրանց տերերի քաղաքական վախերը, քանի որ Ծառուկյանի բարձր քաղաքական վարկանիշը այսօր շատերի համար է իսկական մտահոգվելու առիթ, հատկապես արտահերթ ընտրությունների նախաշեմին:

Մյուս կողմից իրավապահ մարմինների ոչ իրավաչափ գործողությունները նաև մատնեցին, որ այս ամենում կան քաղաքական դրդապատճառներ: Ուրիշ ինչ կերպ կարելի է բացատրել մարդուն առանց իրավական հիմքերի ձերբակալված պահելը, երբ այլ դեպքերում դա մեծ աղմուկ և բողոք կբարձրացներ: Չի բացառվում, որ այս ամենի հիմքում ընկած է քաղաքական մրցակցությունը, քանի որ արտահերթ ընտրությունները ավելի են շիկացնում քաղաքական մթոնոլորտը և սրում մրցակցությունը:

Սակայն ամբողջ հարցը նրանում է, որ իրավական պետությունում քաղաքական մրցակցությունը պետք է լինի բացառապես քաղաքական մեթոդներով, այսինքն ծրագրային, գաղափարական մրցակցություն, ոչ թե մարդկանց ապօրինի ձերբակալելու, «փակելու» մեթոդներով: Նոր Հայաստանին պատիվ չի բերում նման գործելաոճը և հակասում է իրավական պետության գաղափարին:
