Բերման ենթարկվածների իրավունքները մասսայականորեն խախտվել են. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ըստ միասնական իրավապաշտպան թեժ գծի տվյալների՝ միայն ապրիլի 22–ին Երևանի բաժիններ է տարվել նվազագույնը 253 մարդ: Ըստ իրավապաշտպանների՝ սա վերջին 10 տարում մեկ օրում բերման ենթարկվածների թվի ռեկորդ է: Ձերբակալվածների թիվն էլ երեկվա դրությամբ 41 է:

Փաստաբան Տիգրան Սարգսյանն այս օրերին իրավապահ մարմինների գործողություններում բազմաթիվ խախտումներ է արձանագրել:

«Բերման ենթարկված անձի գտնվելու վայրը պետք է հայտնի լինի հարազատներին: Անհապաղ պետք է հայտնեն նրանց: Բացի այդ, բերման ենթարկված անձը հեռախոսազանգի իրավունք ունի: Իր հարազատի հետ տեսակցելու իրավունք ևս ունի: Ավելին ասեմ՝ փաստաբանի հետ առանց տևողության և գաղտնի շփման իրավունք էլ ունի: Նշված բոլոր իրավունքները մասսայականորեն խախտվել են: Նրանց փաստաբաններով ապահովելու հնարավորություն չկա, հարազատներին հայտնի չի լինում նրանց գտնվելու վայրը: Բաժիններով ընկած՝ մարդիկ չեն կարողանում գտնել իրենց հարազատներին»,– «Փաստ»–ի հետ զրույցում ասաց փաստաբանը:

«Գնում եմ բաժին՝ հարցնում, օրինակ՝ Պողոս Պողոսյանը ձեզ մո՞տ է, բայց իրենք էլ չգիտեն, բաժնում բերման ենթարկված նման անձ կա՞, թե ոչ: Սա օրենսդրության պահանջների կոպիտ և էական խախտում է: Ես նաև արձանագրել եմ, թե ինչպես են ոստիկանները երթևեկում ռուսական պետհամարանիշներով: Ոստիկանը եկել, խաղաղ հավաքին է միջամտում և այն էլ՝ ռուսական պետհամարանիշներով: Սա ևս խախտում է, և ոչ միայն խախտում է, այլև ժողովրդի նկատմամբ անհարգալից և արհամարհական վերաբերմունք է»,– ընդգծեց նա:

Գնահատելով Մարդու իրավունքների պաշտպանի աշխատակազմի աշխատանքը, փաստաբանը նշեց. «Ցավոք սրտի, ՄԻՊ–ն իրեն պետական ծառայողի դերում է պատկերացնում: Բայց պետք է ազատ, անկախ և անկողմնակալ լինի: Այսօր չունենք ՄԻՊ, դատական իշխանություն և այդպես շարունակ: Դատավորը մարդկանց կալանավորում է առանց գործի մեջ խորանալու»:

Նշենք, որ բերման ենթարկվածների և ձերբակալվածների վերաբերյալ իրավապահ մարմինների հայտարարություններում որպես պատճառ նշվում է «անօրինական հավաքների» իրականացման հանգամանքը:

Փաստաբանը նկատում է՝ խաղաղ հավաքներ ու երթեր կատարելը քաղաքացու սահմանադրական իրավունքն է:

«Այդ իրավունքն իրացնելու համար քաղաքացին որևէ պաշտոնատար կամ իրավասու մարմնի թույլտվությունը ստանալու պարտավորություն չունի: Հավաքների մասին իրավասու մարմինն իրազեկվում է, որպեսզի հավաքի ժամանակ հասարակական կարգը պահպանի, ոչ թե թույլատրի կամ ոչ: Շատ է օգտագործվում «հավաքն արտոնված չէ» եզրույթը: Նման տերմին օրենսդրության մեջ չկա: Կա ծանուցում: Եթե հավաքի կազմակերպիչները ծանուցում են, դա չի ենթադրում թույլտվություն խնդրել: Դա ընդամենը իրազեկում է, որ պետությունը կարողանա այդ միջոցառման ժամանակ հասարակական կարգ պահպանել: Հավաքների մասին ՀՀ օրենքի 32–րդ հոդվածի համաձայն՝ եթե հավաքը խաղաղ է, ոստիկանությունը պետք է աջակցի հավաքին, և ոչ թե խոչընդոտի այն: Իսկ եթե ոստիկանության կողմից բռնություն է կիրառվում՝ խախտվում է քաղաքացիների իրավունքը: Եթե ոստիկանին ապօրինի հրամաններ են տալիս, պատասխանատվություն է կրում և՛ հրաման տվողը, և՛ կատարողը: Իսկ ոստիկանն ազատվում է պատասխանատվությունից, եթե հրաժարվում է կատարել իր վերադասի ապօրինի հրամանը»,– եզրափակեց Տ. Սարգսյանը:
