Նիկոլ Փաշինյանին, Սասուն Միքայելյանին, Արարատ Միրզոյանին ձերբակալեցին

ՀՀ ՀՔԾ քննիչի վարույթում քննվող քրեական գործի շրջանակներում հանցագործության կատարումը կանխելու նպատակով Օրենքով սահմանված կարգի խախտմամբ հավաք դիտավորությամբ կազմակերպելու և անցկացնելու անմիջականորեն ծագած կասկածանքով, ՀՀ Սահմանադրության 96-րդ հոդվածի 2-րդ մասի պահանջների պահպանմամբ, ձերբակալվել են ՀՀ Ազգային Ժողովի պատգամավորներ Նիկոլ Փաշինյանը, Արարատ Միզոյանը և Սասուն Միքայելյանը:

Մասնավորապես, հիշյալ պատգամավորները բռնվել են հանրորեն վտանգավոր այն արարքների կատարման պահին, որոնք դրսևորվել են այն բանում, որ նրանք «Հավաքների ազատության մասին» ՀՀ օրենքով սահմանված կարգի խախտմամբ ապրիլի 13-ից կազմակերպել և անցկացրել են հավաքներ՝ անտեսելով լիազոր մարմնի՝ Երևանի քաղաքապետարանի կողմից սահմանված սահմանափակումները: Իսկ 2018թ. ապրիլի 19-ից 22-ը Երևան քաղաքի տարբեր վարչական շրջաններում կազմակերպել են հավաքներ, որոնց մասին օրենքով սահմանված կարգով չեն իրազեկել լիազոր մարմնին:

Անօրինական հավաքների, այդ թվում՝ երթերի ընթացքում Նիկոլ Փաշինյանը, Արարատ Միզոյանը և Սասուն Միքայելյանը, նրանց կողմից հրահանգվող անձինք պարբերաբար և կոպտորեն խախտել են «Հավաքների ազատության մասին» ՀՀ օրենքի մի շարք դրույթներ:

Մասնավորապես, խոչընդոտել են հավաքի անցկացման վայրում գտնվող կամ դրան հարող շենքերի, շինությունների կամ այլ տարածքների ազատ մուտքն ու ելքը, հավաքի ընթացքում անհրաժեշտ միջոցներ չեն ձեռնարկել հավաքի բնականոն ընթացքն ապահովելու համար, հավաքը դադարեցնելու մասին ոստիկանության պահանջի մասին չեն տեղեկացրել հավաքի մասնակիցներին:

Ավելին, անօրինական հավաքների, ներառյալ՝ երթերի ընթացքում Նիկոլ Փաշինյանը Արարատ Միզոյանը և Սասուն Միքայելյանը պարբերաբար հորդորել են հավաքի մասնակիցներին և այլ անձանց շրջափակել քաղաքի փողոցները, արգելափակել պետական մարմինների շենքերի մուտքերը, ներխուժել նշված, այդ թվում՝ հատուկ պահպանության ենթակա շենքերի տարածքներ, կազմալուծել դրանց աշխատանքը:

Ի կատարումն այդ կոչերի՝ հավաքի կազմակերպիչները և մասնակիցները պարբերաբար և տևական ժամանակով փակել են մի շարք պողոտաներ և փողոցներ, տրանսպորտային այլ հանգույցներ, արգելափակել են պետական, տեղական ինքնակառվարման մարմինների և մասնավոր կազմակերպությունների շենքերի մուտքերը, խոչընդոտել են դրանց բնականոն գործունեությանը, բռնություն են կիրառել ոստիկանության ծառայողների և այլ անձանց նկատմամբ՝ հանգեցնելով անձանց իրավունքների կամ հանրության շահերի անհամաչափ սահմանափակման:

ՀՀ ԱԺ պատգամավորների ձերբակալման մասին ՀՀ սահմանադրությամբ սահմանված կարգով անհապաղ տեղեկացվել է ՀՀ Ազգային Ժողովի նախագահը:
