Երևանում 20-ամյա փրկարարը «ինտելեկտուալ բնույթի անառակաբարո գործողություններ» է կատարել 14-ամյա աղջկա նկատմամբ

Երևանի ընդհանուր իրավասության դատարանում Արսեն Նիկողոսյանի նախագահությամբ ավարտվել է Ազատ Ն.-ի (անունը փոխված է) գործի դատական քննությունը:

20-ամյա Ազատ Ն.-ին մեղադրանք էր առաջադրվել մի արարքի համար, որի որակումը ժամանակակից տեխնոլոգիաների զարգացման արդյունքում է հայտնվել քրեական օրենսգրքում, և որը առաջիկայում կարող է ավելի հաճախադեպ դառնալ:

Ազատ Ն.-ն մեղադրվել է էլեկտրոնային հաղորդակցության միջոց հանդիսացող համացանցի միջոցով 14-ամյա աղջկա նկատմամբ «ինտելեկտուալ բնույթի անառակաբարո գործողություններ» կատարելու համար՝ ՀՀ քրեական օրենսգրքի 142 հոդվածի 2-րդ մասի 6-րդ կետով:

Ըստ մեղադրանքի՝ 2017 թվականի հունիսի 28-ից մինչև հուլիսի 1-ն ընկած ժամանակահատվածում էլեկտրոնային հաղորդակցության միջոց հանդիսացող համացանցի «Ֆեյսբուք» կայքով հանդես գալով «Անհայտ արվեստագետ» օգտատիրոջ տվյալներով, ապա՝ «Whats up» ծրագրով՝ Ազատ Ն.-ն իր համար ակնհայտ 16 տարին չլրացած՝ 2002 թվականի հոկտեմբերին ծնված աղջկա՝ Վերայի (անունը փոխված է) նկատմամբ կատարել է ինտելեկտուալ բնույթի անառակաբարո գործողություններ՝ ուղարկել է պոռնկագրական լուսանկարներ, սեքսուալ բնույթի թեմաներով զրույցներ է վարել՝ «նպատակ ունենալով գրգռել աղջկա սեռական բնազդն ու առաջացնել անառողջ սեռական հետաքրքրություն»:

Դատարանում ամբաստանյալը միջնորդել է քննությունն անցկացնել արագացված ընթացակարգով: Նա իրեն լիովին մեղավոր է ճանաչել, զղջացել է կատարածի համար:

Մեղադրողը, տուժող աղջիկն ու վերջինիս օրինական ներկայացուցիչը չեն առարկել գործն արագացված ընթացակարգով քննելու դեմ:

Ամբաստանյալ Ազատ Ն.-ն դրական է բնութագրվել ուսումնական հաստատության կողմից՝ նա, պարզվել է… ապագա փրկարար է, սովորում է Ճգնաժամային կառավարման պետական ակադեմիայում:

Դատարանը, անդրադառնալով ամբաստանյալ Ազատ Ն.-ի կողմից ակնհայտ 16 տարին չբոլորած աղջկա նկատմամբ էլեկտրոնային հաղորդակցության ցանցի կիրառմամբ անառակաբարո գործողություններ կատարելու փաստական հանգամանքներին, անհրաժեշտ է համարել պատժի միջոցով «ուղղել» Ազատ Ն.-ին ու կանխել հետագա հնարավոր հանցագործությունները՝ այդ կերպ նպաստելով ամբաստանյալի իրավահպատակ վարքագծի ձևավորմանն ու նրա վերասոցիալականացմանը:

Ըստ այդմ՝ դատարանը որոշել է, որ Ազատ Ն.-ի նկատմամբ անհրաժեշտ է կիրառել քրեաիրավական ներգործության միջոց, որն անմիջականորեն պետք է ներգործի ամբաստանյալի վրա՝ ունենալով կանխարգելիչ բնույթ:

Դատարանը որոշել է, որ Ազատ Ն.-ի նկատմամբ պետք է նշանակվի իրական պատիժ, որը նա պետք է կրի:

Քրեական գործով քաղհայից պահանջ չի ներկայացվել, դատական ծախսեր չեն արձանագրվել:

Ընդհանուր իրավասության դատարանը Ազատ Ն.-ին մեղավոր է ճանաչել ՀՀ քրեական օրենսգրքի 142 հոդվածի 2-րդ մասի 6 –րդ կետով և դատապարտել է 2 տարի իրական ազատազրկման:

Պատժի սկիզբը կհաշվվի Ազատ Ն.-ին փաստացի կալանքի տակ առնելու պահից, երբ դատական ակտը օրինական ուժի մեջ մտնի:
