Ակնհայտ սուտ մատնություն. անձը ոստիկաններին հանիրավի մեղադրել է հանցագործության կատարման մեջ

ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննության ընթացքում հիմնավորվել է, որ քաղաքացի Արմեն Մովսիսյանը, նախազգուշացված լինելով սուտ մատնություն կատարելու համար նախատեսված քրեական պատասխանատվության մասին, հաղորդմամբ հայտնել է, որ 2015թ. հուլիսի 8-ին՝ ժամը 10:00-ից մինչև 23:00-ն ընկած ժամանակահատվածում, անհայտ անձի կողմից իր առանձնատան դռան փականը վնասելու եղանակով ապօրինի բնակարան մուտք գործելով գողության փորձ կատարելուց հետո, դեպքի վայր են ժամանել ոստիկանության երկու աշխատակիցներ, ովքեր տեսնելով գողության փորձի մասին վկայող հետքերը, տան տակնուվրա արված իրերը, իրենից հաղորդում չեն ընդունել և առանց որևէ օրինական գործողություն կատարելու հեռացել են: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Դիմումատուի հաղորդման հիման վրա ՀՀ հատուկ քննչական ծառայությունում հարուցված քրեական գործի նախաքննության ընթացքում պատշաճ ընթացակարգով ստուգվել են Ա. Մովսիսյանի կողմից մատնանշված տվյալները:

Քրեական գործով իրականացված մի շարք քննչական և դատավարական գործողությունների արդյունքում Ա. Մովսիսյանը հայտնել է, որ իրականում սուտ հաղորդում է ներկայացրել, թե, իբր, ոստիկանության երկու աշխատակից իր տանը տեսնելով գողության փորձի մասին վկայող հետքերը, իրենից հաղորդում չեն ընդունել և որևէ գործողություն չեն կատարել:

Քրեական գործի նախաքննության ընթացքում ձեռք բերված ապացույցներով որոշում է կայացվել հանցագործության դեպքի բացակայության հիմքով քրեական գործով վարույթը կարճելու մասին:

Միաժամանակ ակնհայտ սուտ մատնություն կատարելու դեպքի առթիվ, ՀՀ հատուկ քննչական ծառայությունում, հարուցված քրեական գործով Ա. Մովսիսյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 1-ին մասով:

ՀՀ հատուկ քննչական ծառայությունում ավարտվել է հիշյալ քրեական գործի նախաքննությունը: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
