Լավ օրենքը բավարար չէ առողջ մրցակցություն ապահովելու համար. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Հույս կա, որ «Գնումների մասին» նոր օրենքը, որն ուժի մեջ մտնի այս տարվա ապրիլի վերջերին, լույս կսփռի տարիների ընթացքում ամենամեծ կոռուպցիոն ռիսկեր պարունակող գործընթացների վրա: «Թրանսփերենսի Ինթերնեյշնլ» հակակոռուպցիոն հասարակական կազմակերպության գործադիր տնօրեն Վարուժան Հոկտանյանը «Փաստի» հետ զրույցում նշեց, որ ներկայացված նոր օրենքը նախորդի համեմատ թեև բավականին լավն է, սակայն դեռևս պարզ չէ, թե այն որքանով կնպաստի համակարգում առկա ռիսկերը վերացնելու համար:
«Մինչ այս նախարարների մակարդակով երբևէ նման հանդիպում չէր կազմակերպվել: Եվ սա արդեն դրական քայլ է: Կարևոր է նաև, որ ցանկություն կա ավելի ականջալուր լինելու քաղհասարակության կողմից բարձրացված հարցերին, որը նույնպես ողջունելի է: Սակայն պակաս կարևոր չէ, որ նոր օրենքում տեղ գտած դրույթներն իրականում կյանքի կոչվեն»,– ասում է Վ. Հոկտանյանը:
«Բացի այդ, դժվար է ասել, թե որքանով կհաղթահարվեն կոռուպցիոն ռիսկերը, երբ վերջին տարիներին հայտարարված մրցույթներին մասնակցում են մեկից երկու ընկերություն,– ասում է կազմակերպության ղեկավարը: Եվ եթե դրան ավելանում են երկրում առկա կոռուպցիայի ընդհանուր մակարդակը և տնտեսական գործող համակարգը ապա ակնկալել, որ գնումների համակարգը, որպես առանձին վերցրած ոլորտ, հիանալի կկարողանա գործել` հնարավոր չէ»:
Վ. Հոկտանյանի կարծիքով կոռուպցիայի դեմ պայքարի հարցում ավելի լավ արդյունքի հասնելու համար ձեռնարկված ցանկացած նման քայլ պետք է համակարգային բնույթ կրի: Հակառակ դեպքում բոլոր ջանքերը կարող են ջուրը թափվել, իսկ ձեռնարկված քայլերը մնալ ինքնանպատակ:
«Եթե դատական համակարգը շարունակի կոռումպացված մնալ, ապա հասկանալի չէ, թե մրցութային հանձնաժողովների որոշումների բողոքարկման դեպքում որքանով արդար որոշումներ կկայացվեն և որքանով այն կնպաստի արդարության վերականգնմանը: Կամ օրինակ՝ եթե փորձ է կատարվում գնումների համակարգը մաքրել, սակայն բողոքարկման անկախ խորհուրդը շարունակելու է վերևի զանգերով առաջնորդվել, ապա դա նշանակում է, որ ոչինչ էլ չի փոխվի»,– ասում է հակակոռուպցիոն հասարակական կազմակերպության ղեկավարը:
Գնումների գործընթացը կոռուպցիոն ճիրաններից փրկելու հիմնական քայլերից մեկը ավելի անկախ բողոքարկման համակարգ ու հանձնաժողով ունենալն է: Եվ թեև նոր օրենքով այն նախկինի նման կախված չի լինելու ո՛չ ֆինանսների նախարարությունից և ո՛չ էլ կառավարությունից, բայց դժվար է ասել, թե արդյոք այն չի նմանվի գործող այլ «անկախ» մարմիններին: Ուստի դեռ հարց է, թե առաջիկայում ցանկալի թափանցիկության ինչ մակարդակ հնարավոր կլինի ապահովել պետգնումների ոլորտում:
Վ. Հոկտանյանի կարծիքով շատ դժվար է կանխատեսել նաև, թե գնումների գործընթացում տեղի ունեցող փոփոխությունները կկարողանան լոկոմոտիվի դեր կատարել և մնացած համակարգերը նույնպես մաքրել կոռուպցիոն դրսևորումներից, բայց որ կառավարությունը փորձում է գոնե այս ոլորտում ինչ–որ բան փոխել, արդեն իսկ խոսում է այն մասին, որ կոռուպցիայի դեմ պայքարի հարցում նախատրամադրվածության դրական միտումներ կան:
