ԲԴԽ անդամը հրաժարվո՞ւմ է արդարադատություն իրականացնել

Դեռեւս 2017 թվականի նոյեմբեր ամսին փաստաբան Կարեն Կիրակոսյանը դատարան է ներկայացրել երկու բողոք՝ հայտնելով, որ իր պաշտպանյալ Ա.Կ-ի նկատմամբ քրեական գործը հարուցվել է ապօրինի, իսկ հարուցման նախորդած ժամերի ընթացքում Ա.Կ.-ի նկատմամբ իրավապահների կողմից բռնություն է գործադրվել: Այդ մասին ֆեյսբուքում գրառում է թողել փաստաբան Ալեքսանդր Սիրունյանը:

Փաստաբանի գրառումը ներկայացնում ենք ամբողջությամբ.

«Բողոքները վարույթ են ընդունվել դատավոր Արմեն Բեկթաշյանի կողմից, նշանակվել են բազմաթիվ նիստեր, որոնցից ոչ մեկը չի կայացել: Դատախազը նյութերը չի ուղարկել, դատավորը խորհրդակցական սենյակում է, դատախազը չի ծանուցվել ու էլի եսիմ ինչ:

Արդեն անցել է շուրջ 5 ամիս այն դեպքում, երբ նման բողոքները պետք է քննվեն 10 օրյա ժամկետում:

Լավ եմ հասկանում նիտերը ձախողելու պատճառները: Չի ցանկանում քննել, քանի որ ապագա որոշումը այլընտրանք չունի: Մարդուն գրեթե խոշտանգել են, հետո ապօրինի քրեական գործ են հարուցել ու իբր 8 ամիս քննում են՝ մեղքի ապացույցներ որոնելով ու մինչեւ օրս չեն գտնում:

Այլ կարծիք չունեմ. լավ հասկանում եմ, որ դատարանը դիլեմմայի մեջ է, մի կողմից օրինական բողոք, մյուս կողմից դատախազի ու քննիչի շահեր, սակայն սա այդ դեպքը չի: Մարդը ենթարկվել է խոշտանգումների ու ապօրինի քրեական պատասխանատվության ու դատարանը պարտավոր է դրա գնահատականը տալ, այլ ոչ «լավամարդ-վատամարդ» խաղա մարդու ճակատագրի ու առողջության հաշվին»,- ասում է գրառման մեջ:
