Պաշտոնական առաքելությունների աշխատակիցների հարազատները Ֆրանսիայում վարձատրվող աշխատանք կունենան. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Կառավարության՝ հինգշաբթի օրը կայանալիք նիստի օրակարգում ներառված որոշման նախագծերից մեկը վերաբերում է Հայաստանի ու Ֆրանսիայի՝ պաշտոնական առաքելությունների աշխատակիցների ընտանիքի անդամների՝ մյուս պետությունում զբաղվածությանը:

Առաջարկվում է վավերացնել 2017 թ. դեկտեմբերի 22–ին ստորագրված «Հայաստանի Հանրապետության կառավարության և Ֆրանսիայի Հանրապետության կառավարության միջև մի պետության պաշտոնական առաքելությունների աշխատակիցների ընտանիքի անդամների՝ մյուս պետությունում զբաղվածության մասին» համաձայնագիրը, որը ստորագրել է ՀՀ արտաքին գործերի նախարար Էդվարդ Նալբանդյանը:

Համաձայնագրի նպատակն է հնարավորություն ստեղծել կողմերի՝ պաշտոնական առաքելությունների աշխատակիցների ընտանիքի անդամներին մյուս պետությունում իրականացնելու վարձատրվող գործունեություն:

Համաձայնագրի դրույթներին համապատասխան և փոխադարձության հիման վրա յուրաքանչյուր պետության պաշտոնական առաքելությունների աշխատակիցների ընտանիքի անդամները, ովքեր ունեն մյուս պետության արտաքին գործերի նախարարության կողմից տրամադրված կացության հատուկ կարգավիճակ կամ դիվանագիտական քարտ, կարող են ստանալ ընդունող պետության տարածքում վարձատրվող գործունեություն իրականացնելու թույլտվություն:

Նախագծում ասված է, որ վարձատրվող աշխատանք իրականացնող ընտանիքի անդամը ենթարկվում է ընդունող պետության օրենքներին՝ առանց զրկվելու անձնական և բնակության վայրի անձեռնմխելիությունից՝ այս ոլորտում գործող դիվանագիտական սովորույթներին համապատասխան: Նա պահպանում է իր կացության հատուկ կարգավիճակը կամ իր դիվանագիտական քարտը:

Վարձատրվող աշխատանք իրականացնող ընտանիքի անդամը չի օգտվում քաղաքացիական և վարչական իրավազորության նկատմամբ անձեռնմխելիությունից, ոչ էլ՝ աշխատանքային գործունեության հետ կապված դատական որոշման կատարման նկատմամբ անձեռնմխելիությունից, և այդ գործունեությանն առնչվող բոլոր հարցերով ենթարկվում է ընդունող պետության օրենսդրությանն ու դատական ատյաններին:

ՀՀ արդարադատության նախարարությունը համաձայնագրի հետ կապված հայտնել է, որ դրա դրույթները չեն հակասում ՀՀ օրենքներին կամ այլ նորմատիվ իրավական ակտերին և չեն պարունակում ՀՀ նոր օրենք կամ այլ նորմատիվ իրավական ակտ ընդունելու կամ գործող օրենքում կամ այլ նորմատիվ իրավական ակտում փոփոխություններ և լրացումներ կատարելուն վերաբերող նորմեր:

Համաձայնագիրն ուժի մեջ կմտնի՝ դրա ուժի մեջ մտնելու համար անհրաժեշտ ներպետական ընթացակարգերը կատարելու մասին կողմերի վերջին ծանուցումն ստանալու ամսաթվին հաջորդող երկրորդ ամսվա առաջին օրը:

Նախագծում նաև ասված է, որ այս տարվա փետրվարի 5–ի դրությամբ ֆրանսիական կողմից չի ստացվել ծանուցում՝ համաձայնագրի ուժի մեջ մտնելու համար նախատեսված ներպետական ընթացակարգերի կատարման մասին:

Հավելենք, որ համաձայնագիրը կվավերացվի Ազգային ժողովի կողմից:
