«Արա՛, չեմ ջոգում, ձեր մեջ տղա չկա՞․․․». դիտողությունն ավարտվել է զինվորի սպանությամբ

Վերաքննիչ քրեական դատարանում ավարտվել է Գևորգ Կոսոբոգլյանի ու նրա չորս ծառայակիցների գործով բերված վերաքննիչ բողոքների քննությունը:

Գործը քննվել է Սյունիքի մարզի ընդհանուր իրավասության դատարանում Նապոլեոն Օհանյանի նախագահությամբ:

Ըստ մեղադրանքի՝ ժամկետային զինծառայող, 20-ամյա շարքային Գևորգ Կոսոբոգլյանը 2016 թվականի մայիսի 25-ին, ժամը 15.30-ի սահմաններում ծառայակից Պավել Վարդիկյանի հետ գնացել է զորանոցի ննջարան՝ պարզաբանում կատարելու:

Նույն օրը, ժամը14-ի սահմաններում ճաշարանում զինվորներն աղմկել էին, ու ժամկետային զինծառայող Հակոբ Գևորգյանը, զայրանալով, ասել էր. «Մեկը չկա՝ էս գումարտակի բերանի փակի, անտեր ե՞ք, տեր չունե՞ք»:

Գևորգ Կոսոբոգլյանն ու Պավել Վարդիկյանը, գնալով ննջարան՝ վերոհիշյալ արտահայտության պատճառով վիճաբանել, ապա կռիվ են արել մի խումբ զինվորների՝ արտահայտությունն արած Հակոբ Գևորգյանի, ինչպես նաև Սամվել Կարապետյանի, Յուրա Սերոբյանի, Վաչագան Գրիգորյանի հետ:

Ըստ մեղադրանքի՝ Գևորգ Կոսոբոգլյանը ձեռքերով ու ոտքերով հարվածել է Հակոբին ու Սամվելին:

Երբ փոխադարձ կռվի ժամանակ Հակոբը ձեռքով հարվածել է Պավել Վարդիկյանի գլխին, վերջինս Հակոբի գլխին հարվածել է զինվորական աթոռակով:

Գևորգ Կոսոբոգլյանըբռունցքով մեկ անգամ հարվածել է Սամվել Կարապետյանի դեմքին, ապա, ըստ մեղադրանքի, Հակոբ Գևորգյանին կյանքից զրկելու դիտավորությամբ իր մոտ եղած դանակով հարվածել է Հակոբի կրծքավանդակի ձախ մասին ու սպանել է նրան:

Գևորգ Կոսոբոգլյանին մեղադրանք էր առաջադրված ինչպես դիտավորյալ սպանության, այնպես էլ զինծառայողների փոխհարաբերությունների կանոնագրքային կանոնները խախտելով՝ խմբի կազմում երկու անձանց նկատմամբ բռնի գործողություններ կատարելու համար՝ ՀՀ քրեական օրենսգրքի 104 հոդվածի 1-ին մասով և 359 հոդվածի 2-րդ մասի 1-ին, 2-րդ կետերով:

Բացի Կոսոբոգլյանից՝ ամբաստանյալի աթոռին էին նաև ննջարանում խմբակային ծեծկռտուքի մասնակից չորս զինծառայողներ՝ Սամվել Կարապետյանը, Յուրա Սերոբյանը, Պավել Վարդիկյանը, Վաչագան Գրիգորյանը, ովքեր մեղադրվում էին միայն ՀՀ քրեական օրենսգրքի 359 հոդվածի 2-րդ մասով:
