Ամբաստանյալը ազատ արձակվեց. դատավորը վերաորակել էր նրա մեղադրանքը. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Երեկ Տավուշի մարզի ընդհանուր իրավասության դատարանի նիստերի դահլիճից ազատ արձակվեց «Դիլիջան» ազգային պարկի հատուկ ջոկատի աշխատակից Արմեն Սարգսյանը: Նա մեղադրվում էր Հաղարծին գյուղի բնակչից 140 հազար դրամ կաշառք վերցնելու մեջ։

Սարգսյանը մեղադրվում էր Քրեական օրենսգրքի 311 հոդվածի 2–րդ մասով՝ մի խումբ անձանց կողմից նախնական համաձայնությամբ կաշառք վերցնելու համար: Դատախազության կողմից ներկայացված մեղադրական եզրակացության համաձայն՝ Արմեն Սարգսյանին սպառնում էր 6 տարվա ազատազարկում։

Սակայն դատարանը չէր բավարարել դատախազի պահանջը: Դատավոր Ռաֆիկ Մելքոնյանը վերաորակել էր Արմեն Սարգսյանին առաջադրված մեղադրանքը: 311–րդ հոդվածի 2–րդ մասի փոխարեն նա մեղադրվեց նույն հոդվածի 1–ին մասով, այն է՝ միանձնյա կաշառք վերցնելը, որը նախատեսում է 3 ամսից մինչև 3 տարվա ազատազրկում: Դատարանը չէր կարողացել ապացուցել Արմեն Սարգսյանի և նույն գործով մեկ այլ ամբաստանյալ՝ Կամո Պողոսյանի միջև նախնական համաձայնության փաստը։ Ի դեպ, վերջինս նույնպես երեկ ազատ արձակվեց և լքեց նիստերի դահլիճը:

Դատարանը Սարգսյանին դատապարտել էր 9 ամսվա ազատազրկման: Իսկ նա հենց այդքան ժամանակ էր գտնվում անազատության մեջ: Դատարանը համարել էր, որ 9 ամսվա ազատազրկումը բավարար է նրա համար։

Արմեն Սարգսյանի փաստաբան Կարեն Բատիկյանը «Փաստի» հետ զրույցում նշեց, որ ցանկություն ունի բողոքարկել դատարանի վճիռը, քանի որ Սարգսյանի հանցանքը դատական ողջ գործընթացում այդպես էլ չէր ապացուցվել, սակայն դեռ չգիտի այդ կապակցությամբ Արմենի դիրքորոշումը։
