Ժաննա Ալեքսանյան. «Նոր օրինագիծը շանտաժ է, որով մարդուն միշտ կարող են նեղը գցել». «Փաստ»

«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարությունը նոր նախագիծ է ներկայացրել, ըստ որի առաջարկում է քրեականացնել ահաբեկչության, ահաբեկչության ֆինանսավորման և միջազգային ահաբեկչության հանցագործություն կատարելու հրապարակային կոչերը: Նախագծում ասված է, որ ժամանակակից տեխնիկական առաջընթացի պայմաններում հրապարակայնորեն, այդ թվում զանգվածային հաղորդակցության միջոցների գործադրմամբ հանցագործությունների, ահաբեկչական գործողությունների կատարման կոչերը իրենցից բարձր հանրային վտանգավորություն են ներկայացնում:

Առաջարկվում է լրացում կատարել Քրեական օրենսգրքի 23–րդ գլխում, որի համաձայն առավել խիստ պատասխանատվության միջոցներ կսահմանվեն հրապարակայնորեն ահաբեկչությունն արդարացնելու, քարոզելու, ինչպես նաև ահաբեկչություն կատարելու, ֆինանսավորելու համար: Իրավապաշտպան Ժաննա Ալեքսանյանը «Փաստի» հետ զրույցում նկատեց, եթե իսկապես կա ահաբեկչության քարոզ կամ ահաբեկչության արդարացում, այն անկասկած պետք է պատժվի:

«Հարցն այն է, որ մենք չգիտենք, թե իրենք ինչն են համարելու ահաբեկչության քարոզ կամ արդարացում: Շատ կարևոր է կիրառումը: Ես չգիտեմ, թե ինչպես է կիրառվելու օրենքը:

Առաջարկվող ցանկացած օրենքի փոփոխություն և օրենքի նախագիծ քաղաքացիների համար չէ՝ իշխանությունն ամեն ինչ իր համար է անում: Հայաստանի Հանրապետության քաղաքացիներն այս առումով շատ մեծ փորձ ունեն և դա կասկածից վեր է: Նույնը նշված օրինագիծն է, որով նրանք քաղաքացիների գլխին սպառնալիք են կախում»,–ասաց իրավապաշտպանը՝ հավելելով, որ պետք է հասկանալ, թե իրենք ինչն են որպես ահաբեկչության քարոզ կամ արդարացում ընդունելու: «Պետք է տեսնենք, թե ինչ համատեքստում են դա անելու, քանի որ որևէ վստահություն չկա իրավապահ համակարգի նկատմամբ: Օրենքն ընդունում ու առաջարկում են իրենց համար՝ մեկուսացնելու և իզոլացնելու անցանկալի անձանց: Հիմա, օրինակ, «Սասնա ծռեր»–ը դատական նիստերի ժամանակ հայտարարություններ են անում: Այս միջոցով սպառնալիք են կախում հանրության գլխին՝ հասկացնելով, թե ինչ է սպասվում իրենց, եթե որևէ բան արդարացնեն կամ խոսեն: Սա շանտաժ է, որով մարդուն միշտ կարող են նեղը գցել: Այս օրինագիծը մադու դեմ օգտագործելու համար է: Սրված իրավիճակներում մասնավորապես այն շատ հեշտ է օգտագործել և վախի մթնոլորտ ստեղծել: Նրանք այնքան են ամրապնդում վախի մթնոլորտը, որ մարդիկ հանկարծ հույս չունենան, որ չենթարկվելու դեպքում կարող են հանգիստ ապրել: Ամբողջ կոնտեքստը սա է: Այնպես որ՝ Հայաստանում օրենքը չի գործում»,– ընդգծեց Ժաննա Ալեքսանյանը:

Նրա խոսքով՝ քանի որ ՀՀ քաղաքացիների կողմից իրավապահ մարմինների նկատմամբ բացահայտ անվստահություն կա, այդ իսկ պատճառով վստահել և հանգիստ խոսել հնարավոր չէ:
