Շվեյցարիայի քաղաքացին կալանավորվել է սխալ թարգմանության հետևանքով. փաստաբան (փաստաթղթեր)

Հունվարի 8-ին, Երեւանի «Զվարթնոց» օդանավակայանում, ձերբակալել են ՌԴ քաղաքացի Արտեմ Սատալկինին: Վերջինս բերման է ենթարկվել, ապա կալանավորվել Շվեյցարիայի Համադաշնության իրավապահ մարմինների կողմից հետախուզվելու փաստի հիման վրա, այն է՝ գողություն, սեփականության վնաս, ներխուժում բնակարան, թմրանյութերի վերաբերյալ դաշնային օրենքի խախտում։

ԼՈւՐԵՐ.com-ի թղթակցի հետ զրույցում պաշտպան Ալեքսանդր Սիրունյանը նշեց, որ Արտեմ Սատալկինին կալանավորել են սխալ թարգմանության հետևանքով։

«Հունվարի 11-ին գնացինք դատարան, ասացի՝ չգիտեմ, թե ով է ֆրանսերենից թարգմանություն կատարել, բայց սխալ է: Պատասխանեցին, որ դատախազությունում նման ծառայություն ունեն, որտեղ էլ թարգմանվել է։ Դատավոր Ռուբեն Ներսիսյանը միջնորդությունը բավարարեց, կալանք նշանակվեց՝ 30 օրով։ Երեկ դիմել են՝ կալանքը երկու ամսով երկարացնելու համար. դատավորն արդեն Արշակ Վարդանյանն է։ Իսկ ես ասացի, որ բացի այն, որ թարգմանությունը օրենքի խախտումով է կատարված, նաև կեղծ է, քանի որ տեքստի մեջ այլ բան է գրված»,- ասաց փաստաբանը:

Նշենք, որ Երևանի ընդհանուր իրավասության դատարանը բավարարել է Սատալկինին 2 ամսով կալանավորելու միջնորդությունը. «Խախտում է տեղի ունեցել, քանի որ «Անձի հանձնման մասին» կոնվենցիայի երկրորդ հոդվածում ասվում է, որ անձը չի կարող հանձնվել, եթե ստացող երկրում, այսինքն՝ Շվեյցարիայում, այդ հանցագործության պատժի չափը մեկ տարուց պակաս է։ Մենք արդեն երկու ամիս է՝ ասում ենք, որ Շվեյցարիայի քրեական օրենսգրքով այդ հանցագործության համար պատիժը պակաս է մեկ տարուց, դուք իրավունք չունեք նրան հանձնելու։ Այսինքն՝ նա չէր էլ կարող կալանավորվել: Բերել են թարգմանություն, ըստ որի, Սատալկինի մեղադրանքը հինգ տարի և ավել է: Դատախազը մեզ փաստաթուղթ է բերում՝ ասելով, թե լավ չգիտեք ոչ Շվեյցարիայի օրեսնդրությունը, ոչ էլ լեզվաբանությունը. թարգմանությունում այդպես է գրված»,- ասաց Ալեքսանդր Սիրունյանը։

Հարցին՝ այդ դեպքում ինչո՞ւ են կալանավորել քաղաքացուն, փաստաբանն ասաց.

«Հիմա հենց դա ենք ուզում պարզել, ասում ենք՝ Շվեյցարիայից բնօրինակ թղթեր տվեք՝ չեն տալիս, տալիս են դատախազի բերած թարգմանությունը, որը կեղծ է»:

Սիրունյանն ասաց նաև, որ Հայաստանում Շվեյցարիայի դեսպանատնից իրենց հարցին ի պատասխան հաստատել են, որ սխալ է արվել։ Նա ընդգծեց՝ այն թղթերը, որոնք թարգմանվել և որոնց հիման վրա կալանավորվել է իր պաշտպանյալը՝ հանձնել է նոտարական մի քանի գրասենյակների և ստացել իրենց կողմից սպասվող թարգմանությունը։
