Մեկ միլիոն դրամ տուգանք՝ առանց թույլտվության հրավառության համար. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Կառավարության նիստում հաստատվեց Երևանի քաղաքապետի կողմից ներկայացված առանց թույլտվության հրավառություն իրականացնելու համար տուգանելու մասին օրենքի նախագիծը:

Մեզանում տոները հիշվում են տարբեր իրողություններով, սակայն դրանցից ամենատպավորիչը թերևս հրավառություններն են։ Հասկանալի է, երբ տոնական օրերին, համաքաղաքային կամ համապետական միջոցառումների ժամանակ կազմակերպվում են տարբեր հրավառություններ։ Դրանք իրենց մեջ ունեն յուրահատուկ սիմվոլիկա։

Սակայն նույնչափ անհասկանալի է, երբ մարդիկ ունենում են անձնական, ընտանեկան միջոցառումներ և անպատեհ ժամերին սկսում են կազմակերպել հրավառություններ։ Այդ ամենի ուղղակի հետևանքների կրողներն այն շենքերի բնակիչներն են, ովքեր ապրում են այս կամ այն ռեստորանային համալիրի կամ ժամանցային կենտրոնի մոտ։

Գիշերվա մի ահասարսուռ ժամի զգում ես խլացնող ձայներ, որոնք ոչ միայն խաթարում են մեր քաղաքացիների հանգստի իրավունքը, անակնկալ վախի մատնում երեխաներին, այլ նաև կարող են լուրջ հիվանդությունների պատճառ հանդիսանալ։ Վերջին փուլում այս մասով հասարակական դժգոհությունը շատ մեծ էր։

Եվ ահա, Երևանի քաղաքապետարանը, անսալով բնակիչների խնդիրներին, գնացել է բավականին խելամիտ որոշման։ ՀՀ Կառավարությունը հավանության է արժանացրել Երևանի քաղաքապետ Տարոն Մարգարյանի առաջարկությունը։ Ըստ այդ առաջարկության՝ առանց թույլտվության հրավառություն իրականացնողին տուգանել 1 միլիոն դրամի չափով: Նույն արարքը մեկ տարվա մեջ երկրորդ անգամ կատարելու դեպքում 2 միլիոն դրամով տուգանել: Նույն տրամաբանությամբ առաջարկվում է նաև տուգանել առևտրային կամ ծառայություններ մատուցող այն կազմակերպություններին, որոնք կխախտեն օրենքով սահմանված հրավառություն իրականացնելու կարգը: Նշված կազմակերպություններն առաջին անգամ խախտման համար կտուգանվեն 1 միլիոն դրամի չափով, իսկ նույն արարքը մեկ տարում երկրորդ անգամ կատարելու դեպքում՝ 2 միլիոն դրամի չափով: Այս տուգանքները կսահմանվեն «Վարչական իրավախախտումների վերաբերյալ» ՀՀ օրենսգրքում: «Տեղական տուրքի և վճարների մասին» օրենքում էլ նոր հոդված կավելացվի, որի համաձայն՝ համայնքի վարչական տարածքում տեխնիկական և հատուկ նշանակության իրականացնելու թույլտվության համար 50000–300000 դրամ վճար կսահմանվի:

Հիշեցնենք, որ որոշման նախագիծը դեռ պետք է քննարկվի ԱԺ–ում, որպեսզի լինեն օրենսդրական և իրավական համապատասխան փոփոխությունները: Հուսանք, այդ քննարկումը որևէ խնդրի չի հանգեցնի: Մենք նույնպես, որպես շարքային շահառուներ, կոչ ենք անում, որպեսզի հարցը վերջնական և դրական լուծում ստանա:

Սա շատ կարևոր հանգամանք է։ Եթե կպնում ես ձեռնարկատերերի կամ զվարճացողների գրպաններին, ապա դա օրինակ է ծառայում մյուսների համար ու հաստատապես ունենում է ազդեցիկ հետևանքներ։ Մյուսները կամ խուսափում են նման գործունեություն ծավալելուց, կամ փորձում են դա անել իրավական հայեցակարգով և ողջամիտ ժամերի։ Հուսանք, բավականին սեղմ ժամկետներում, մեր համաքաղաքացիները կզգան այս առաջարկի և որոշման ազդեցիկության արդյունքները։
