Սահմանադրական պարտականոււթյունը՝ այլևս պարզապես հուզմունք. Լիլիա Շուշանյան

Մենք այլևս ապրում ենք պետական-հասարակական մի իրականության մեջ, որտեղ «Խաղաղության հաստատման» օրվա շնորհավորական ուղերձում սահմանադրական պարտականությունը վերածվում է պարզապես «հուզմունքի», իսկ հայրենակիցների լեգիտիմ իրավունքներից հրաժարումը՝ պետական քաղաքականության։
 
Օգոստոսի 8-ին վարչապետի կայքում հրապարակված ուղերձում ասվում է. «…խաղաղությունն անշրջելի դարձնելու համար անհրաժեշտություն է «Լեռնային Ղարաբաղի հայերի վերադարձի» եւ «Ադրբեջանից հայ փախստականների վերադարձի» իրավունքի մասին, իսկ Ադրբեջանում «Արեւմտյան Ադրբեջանի եւ արեւմտաադրբեջանցիների վերադարձի» իրավունքի մասին խոսույթները չշարունակելը»։
 
Բռնի տեղահանված արցախցիների վերադարձի լեգիտիմ իրավունքը չի կարող հավասարեցվել Ադրբեջանի պետական քաղաքականությամբ և ֆինանսավորմամբ առաջ մղվող՝ «արևմտյան ադրբեջանցիների պատմական հողեր վերադարձի» զավթողական ծրագրին։ Առաջինը մարդկանց՝ միջազգային իրավունքով պաշտպանվող իրավունքն է, երկրորդը՝ պետականորեն կանխամտածված ու կառուցված կեղծ զավթողական օրակարգ։ Փաստերի հետևից հեռու գնալ պետք չէ․ պատմությունը, արխիվներն ու Ադրբեջանի պետական բյուջեից այսօրվա հատկացումները բավական են։ Բայց դա արդեն առանձին, ծավալուն հոդվածի թեմա է։
Եվ ֆիքսենք ամենակարևորը․ Հայաստանի որևէ կառավարություն կամ պաշտոնյա իրավասու չէ քաղաքական նպատակահարմարությունից ելնելով կամ ընդհանրապես հրաժարվել արցախցիների՝ միջազգային իրավունքով երաշխավորված իրավունքից։
 
Այս երկու երևույթների արհեստական հավասարեցումը պարզապես Հայաստանի ներքաղաքական դաշտում Ադրբեջանի բացահայտ զավթողական հավակնությունների մասին խոսքը լռեցնելու փորձ է՝ այն էլ «հաստատված խաղաղության» պայմաններում։
 
Միաժամանակ սա արտաքին դաշտում սեփական անկարողության քողարկում է՝ նույն հարևանից չկարողանալու պահանջել դադարեցնել ոչ թե պարզապես «խոսույթը», այլ պետականորեն վարվող քաղաքականությունը։ Այլապես այդ պահանջը ոչ թե Ադրբեջանի ժողովրդին ուղղված շնորհավորական ուղերձում կհնչեր, այլ գոնե մեկ անգամ՝ նույն օրը կայացած հեռախոսազրույցում՝ այդ քաղաքականության ճարտարապետ Ալիևին։
 
Խաղաղությունը սկսվում է ոչ թե ճիշտ բառապաշար ընտրելուց, այլ չլուծված խնդիրները հասցեական լուծելուց ու չկոծկելուց։
 
Եվ վերջապես, դժվար է խոսել «մեր սերունդների խաղաղ համակեցության իրավունքի» մասին, երբ մեր հայրենակիցները շարունակում են անազատության մեջ մնալ Ադրբեջանում։
 
2021-ի նախընտրական օրերին վարչապետն ասում էր՝ գերիները «մի քանի ամիս էլ կսպասեն, մեզ կներեն»։ Անցել է հինգ տարի։ Գերիները դեռ սպասում են։ Իսկ նրանց պաշտպանության՝ պետության սահմանադրական պարտականությունն այսօր արդեն ձևակերպվում է պարզապես որպես «մեզ բոլորիս շատ հուզող և անհանգստացնող» հարց։
 
Հիշեցնեմ՝ ՀՀ Սահմանադրության 47-րդ հոդվածի համաձայն՝ «Հայաստանի Հանրապետության քաղաքացիները Հայաստանի Հանրապետության սահմաններից դուրս գտնվում են Հայաստանի Հանրապետության պաշտպանության ներքո՝ միջազգային իրավունքի հիման վրա»։
Սահմանադրական պարտականությունը հուզմունք չէ։
