Ծառուկյանի գործը միջազգային ուշադրության կենտրոնում. GAR-ի հրապարակումը

Global Arbitration Review (GAR)-ը՝ միջազգային առևտրային և ներդրումային արբիտրաժի ոլորտի ամենահեղինակավոր մասնագիտացված հրատարակություններից մեկը, անդրադարձել է Գագիկ Ծառուկյանի շուրջ ստեղծված իրավիճակին՝ մասնավորապես Բելառուսի և Ռուսաստանի երկքաղաքացի, գործարար Նիկալայ Վինիցկու՝ Հայաստանի դեմ միջազգային արբիտրաժ նախաձեռնելու մտադրությանը՝ հրապարակելով «Գործարարը սպառնում է Հայաստանին՝ ակտիվների «քաղաքական» բռնագրավման պատճառով» («Businessman threatens Armenia over “political” seizure of assets») վերտառությամբ հոդվածը, որը, մասնակի կրճատումներով ներկայացնում եմ ստորև. 

«Բելառուսի և ՌԴ-ի երկքաղաքացի գործարար Նիկալայ Վինիցկին սպառնացել է Հայաստանի դեմ ներդրումային արբիտրաժ նախաձեռնել՝ իր ակտիվների բռնագրավման և իր բիզնես գործընկերոջ՝ միլիարդատեր, Հայաստանի ընդդիմադիր կուսակցություններից մեկի առաջնորդ Գագիկ Ծառուկյանի ձերբակալության պատճառով։
Վինիցկին իր խոսնակի միջոցով տարածած հայտարարությամբ հայտնել է, որ երկուշաբթի Հայաստանին պաշտոնապես տեղեկացրել է իր մտադրության մասին՝ միջազգային պահանջներ ներկայացնելու Հայաստանի և Բելառուսի, Հայաստանի և Ռուսաստանի միջև գործող երկկողմ ներդրումային պայմանագրերի, ինչպես նաև Եվրասիական տնտեսական միության մասին պայմանագրի հիման վրա։
 
Հայտարարության համաձայն՝ այս գործը կարող է դառնալ առաջիններից մեկը, որը երբևէ Հայաստանի դեմ կներկայացվի Եվրասիական տնտեսական միության մասին պայմանագրի հիման վրա։
 
Վեճը վերաբերում է Վինիցկու ներդրումներին հետևյալ չորս ընկերություններում՝ «Արարատ Ցեմենտ», «Մուլտի Գրուպ Կոնցեռն», «Մուլտի Ուելնես Կենտրոն» և «Երևանի Արարատ կոնյակի-գինու-օղու կոմբինատ»։
Այս բոլոր չորս ընկերությունների հիմնական բաժնետերը միլիարդատեր Գագիկ Ծառուկյանն է՝ «Բարգավաճ Հայաստան» կուսակցության հիմնադիրն ու նախագահը։
Վինիցկու խոսքով՝ հնարավոր հայցը վերաբերում է կառավարության կողմից ընտրությունների ընթացքում իր ներդրումները «քաղաքական նպատակներով» թիրախավորելու ենթադրյալ արշավին՝ կամայական և խտրական միջոցների կիրառմամբ։ Նա պնդում է, որ իրավապահ մարմիններն ու դատական համակարգը վերահսկողություն են հաստատել նշված ընկերությունների նկատմամբ, իսկ այս ամսվա սկզբին ձերբակալել են նաև Գագիկ Ծառուկյանին։
 
Reuters-ի փոխանցմամբ՝ Հայաստանը վերահսկողություն է սահմանել Ծառուկյանին պատկանող ցեմենտի գործարանի նկատմամբ և նրան ձերբակալել՝ Իրանից 21 միլիոն ԱՄՆ դոլար արժողությամբ ապրանքների ներմուծման ընթացքում խարդախություն կատարելու կասկածանքով։ Ընկերության նկատմամբ վերահսկողություն սահմանելու գործընթացին նախորդել էր Հայաստանի հակակոռուպցիոն դատարանի որոշումը, որով ընկերության բաժնետոմսերը պետք է փոխանցվեին պետությանը։
 
Ծառուկյանի ձերբակալությունը նույնպես կարող է հանգեցնել պետության դեմ արբիտրաժային վարույթի։ Երկու շաբաթ առաջ փաստաբան Էլինար Վարդանյանը տեղական լրատվամիջոցներին հայտնել էր, որ Գագիկ Ծառուկյանի ձեռնարկատիրական գործունեությամբ զբաղվելու իրավունքի խախտումը կարող է հիմք հանդիսանալ միջազգային արբիտրաժային վարույթ սկսելու համար։
Իր նախընտրական քարոզարշավի ընթացքում Հայաստանի վարչապետ Նիկոլ Փաշինյանը խոստացել էր նախաձեռնել քրեական գործեր, որոնք ուղղված կլինեն ընդդիմադիր երեք կուսակցությունների առաջնորդների, այդ թվում՝ Գագիկ Ծառուկյանի, ենթադրաբար «ապօրինի ձեռք բերված ակտիվների» բռնագանձմանը։
