Ասում էին՝ ՀԷՑ-ում մտել են բոլորի գրպանը, հավելագրում արել. այդ կետը դատարանը չհիմնավորած է համարել. փաստաբան (տեսանյութ)

Վարչական դատարանում բողոքարկել էինք ՀԾԿՀ որոշումը, որով որոշվել էր ՀԷՑ-ին բաշխիչ ցանցերի լիցենզիայից զրկել: ՀԾԿՀ-ն որոշել էր յոթ առանձին հիմքերով զրկել լիցենզիայից, դատարանում քննարկել ենք բոլոր յոթը, ընդ որում՝ վեցն առանձին հիմքեր են, 7-րդն ութ կետից բաղկացած հիմք է: Այս մասին ասուլիսի ժամանակ ասել է փաստաբան Արամ Օրբելյանը:

«Դատական նիստերը բավականին ինտենսիվ են եղել և վերջինն ավարտվել է առավոտյան ժամը 3-ն անց, 13 ժամ է տևել: Ովքեր դիտել են դատական նիստերը, կտեսնեին, որ այն հիմնական փուլը, որտեղ ապացույցների հետազոտում պետք է տեղի ունենա ունենա և ակնկալվում էր, որ ՀԾԿՀ-ն պետք է շատ հստակ ասի՝ այս խախտումը հաստատվում է այս ապացույցով, դրան պատրաստ չէր և ամեն հարցի քննարկմանը բավականին երկար ապացույցներն էին նայում, փորձում էին ասեին՝ որ փաստաթուղթը որի հետ համադրենք և արդյունքում ակնհայտ էր, որ հանգամանքները չեն հաստատվում»,-նշել է նա։ 

Փաստաբանն ասել է, որ դատարանն առաջին, երկրորդ, երրորդ և յոթերորդ կետերը համարել է չհիմնավորված, ուժի մեջ է թողել չորրորդ, հինգերորդ և վեցերորդ կետերը, 6.1-ը, որն առանձին կետ է։ 

«Հինգերորդն ու վեցերորդը նույն բանի մասին են, վերաբերում են ՀԷՑ-ի կողմից ենթադրաբար երաշխավորություններ տրամադրելուն, չորրորդը վերաբերվում է ՀԷՑ-ի կողմից ՀԾԿՀ-ին սխալ կամ ոչ ամբողջական տեղեկատվություն տրամադրելուն»,-նշել է նա:

Օրբելյանն անդրադարձել է երկրորդ կետին, որը քաղաքականապես ամենաքննարկվածներից մեկն է:

«Երկրորդ կետը՝ այն, որ մտել են բոլորի գրպանները, հավելագրումների մասին էր խոսքը գնում, միլիոնավոր բաժանորդների մասին էր, երբ ՀԷՑ-ն ունի 1 մլն 80 հազար բաժանորդ, այսինքն՝ 1 մլն կարող ենք ասել,  միլիոնավոր, ամեն դեպքում, չի կարող լինել: Այդ ձևակերպումներով հրապարակումներ եղան, հետո տարբեր քննարկումներ եղան, դատարանն ընդամենը արձանագրել է հետևյալը՝

«Այս պայմաններում ներկայացված թվային տվյալները, թեև կարող են վկայել առանձին խախտումների առկայության մասին, չեն կարող ինքնին բավարար հիմք հանդիսանալ դրանց համակարգված բնույթը հաստատելու համար, քանի որ առանց հարաբերակցական գնահատման հնարավոր չէ եզրակացնել, թե արձանագրված դեպքերը կրում են զանգվածային և կրկնվող բնույթ, թե՞ ունեն բացառիկ կամ դրվագային բնույթ: Հետևաբար, վարչական մարմնի կողմից համակարգված խախտումների վերաբերյալ արված եզրահանգումը չի ապահովում բավարար հիմքերով»:

Մինչև այդ էլ արձանագրել էր, որ նշված ընդհանուր ցուցանիշից չի բխում, թե կոնկրետ որ ժամանակահատվածում, որ հաշվիչների կամ որ անձանց գործողությունների արդյունքում է ձևավորված տարբերությունը»,-պարզաբանել է փաստաբանը։
