Հայաստանյան արդարադատության իրական դեմքը

Երևանի առաջին ատյանի դատարանը երեկ 2 ամսով կալանավորել է առողջական խնդիրներ ունեցող դպրոցական Դավիթ Մինասյանին, ով ընդամենը հանդգնել էր իր դժգոհությունը հայտնել Նիկոլ Փաշինյանի գործողություններից Սուրբ Աննա եկեղեցում։ Թեպետ բազմաթիվ իրավապաշտպաններ, նույնիսկ իշխանությանը լոյալ անձինք պահանջում էին ազատ արձակել Դավիթ Մինասյանին, տխրահռչակ դատավոր Մնացական Մարտիրոսյանը կալանքի որոշում կայացրեց։ Ընդ որում, ի սկզբանե, երբ այս կալանքի գործով դատավոր նշանակվեց Մարտիրոսյանը, ակնհայտ էր, որ կայացվելու է իշխանության պահանջած որոշումը։

63-ամյա Մարտիրոսյանը դատական համակարգում է գրեթե 30 տարի, արդեն հասցրել է դառնալ Հայաստանի դատական համակարգի չգոյության խորհրդանիշը՝ իր պաշտոնավարման ողջ ընթացքում մեղադրական վճիռներ կայացնելով աղմկահարույց ամենահայտնի գործերով։ Հենց Մնացական Մարտիրոսյանն էր, որ 2000-ականների սկզբում «Պապլավոկում» Պողոս Պողոսյանի սպանությունից հետո «անզգույշ սպանություն» որակմամբ ազատ արձակեց Ռոբերտ Քոչարյանի թիկնապահ Աղամալ Հարությունյանին։

Քոչարյանի օրոք Մարտիրոսյանը վճիռներ է կայացրել տարբեր ընդդիմադիր գործիչների, այդ թվում՝ Ժիրայր Սեֆիլյանի նկատմամբ, 4 տարվա ազատազրկման դատապարտել «Ժամանակ Երևան» թերթի խմբագիր, ներկայումս «Հանուն Հանրապետության» կուսակցության նախագահ Արման Բաբաջանյանին։ Մարտի 1 գործով վճիռներ է կայացրել մի քանի հայտնի անձանց, այդ թվում ներկայումս Փաշինյանի թիմակից Սասուն Միքայելյանի նկատմամբ, 7 տարվա ազատազրկման էր դատապարտել նաև Նիկոլ Փաշինյանին։ 2018 թվականի իշխանափոխությունից հետո թվում էր, թե նոր իշխանություններն ինչ-որ քայլեր կձեռնարկեն դատական համակարգը շտկելու ուղղությամբ, ու առաջին հերթին կհեռացնեն հենց Մնացական Մարտիրոսյանին։

Ոչ միայն Փաշինյանը չգնաց նման քայլի, այլև նույնիսկ փորձում էին բարձրացնել Մարտիրոսյանի պաշտոնը։ Նրան պահեցին և այժմ դակում է գործող իշխանությունների բոլոր ապօրինի որոշումները։ Ժամանակին Փաշինյանն ինքն էր ասում, որ պետք է Մարտիրոսյանի արձանը դնել որպես Հայաստանի դատական համակարգի խորհրդանիշ, և այժմ էլ ինքը օգտվում է նույն այդ Մարտիրոսյանի կեղտոտ ծառայություններից։
