Հայաստանում գործող փաստաբանների մի ամբողջ աստղաբույլ պետք է ցույց տա, որ մեղադրանքն իրականում «փուչիկ» է

ԶԼՄ հարգելի' գործընկեր,

Մոտեցել ենք 18 արդարների գործով բուն դատավարությանը: Առանցքային կարևորության փուլ է` հետազոտման ենթակա ապացույցների ծավալի հարցն է քննարկվում:

 Այսուհետ լուրջ «մարտեր» են սպասվում դատական նիստերի դահլիճում. Հայաստանում գործող փաստաբանների մի ամբողջ աստղաբույլ պետք է ցույց տա, որ մեղադրանքն իրականում «փուչիկ» է:

Ամիսներ շարունակ իշխանական տարբեր գործիչներ, իրավապահ մարմինների ներկայացուցիչներ թմբկահարել են իրենց ունեցած ապացույցների մասին:

Այս փուլում արդեն ժամանակն է խոսելու դրանց մասին: Ի՞նչ է դա նշանակում. հատ-հատ ներկայացնել բոլոր ապացույցները, հիմնավորել, թե որ ապացույցով ինչ հանգամանք է ապացույցվում և դա որ մեղադրյալի մեղավորությունն է ապացուցում:

Բայց տեսնում ենք որ անհատականացնելու փոխարեն, Դատախազությունը լղոզված է ներկայացնում ապացույցները: Ասում են` բոլոր ապացույցները բոլոր մեղադրյալներին են վերաբերում: Այդպես լինել պարզապես չի կարող:

Ոչ միայն որովհետև դա հակասում է պարզ տրամաբանությանը, այլ նաև օրենքին. ամեն ոք իրավունք ունի անհատապես իմանալու որ ապացույցը ինչպես է հիմնավորում իր մեղադրանքը:

Իրապես, չէին կարող 18 հոգանոց խմբի բոլոր անդամները «հանցավոր» խմբում նույն գործողությունները կատարեին:

Հանրությունը պետք է տեսնի ապացուցման ենթակա բոլոր հանգամանքների և բոլոր մեղադրյալների վերաբերյալ կա՞ արդյոք տեռորիզմի և իշխանազավթման ապացույց:

Ինչո՞ւ չի Դատախազությունը ցանկանում այդպես անել, որովհետև տվյալ դեպքում հստակ կերևա, որ հանցագործությունը հիմնավորող ապացույց չկա:
