Ո՞ւր է շտապում Վերաքննիչ դատարանը. պաշտպանը` Կարապետյանի խափանման միջոցի դեմ բողոքի մասին

Փաստաբանի խոսքով՝ վերաքննիչ ատյանում գործերով հիմնական լուծումները լինում են գրավոր ընթացակարգով՝ 10-օրյա ժամկետում, սակայն այս անգամ ժամկետը խախտվում է։

Գործարար, բարերար Սամվել Կարապետյանի խափանման միջոցի փոփոխության դեմ ներկայացված վերաքննիչ բողոքը քննվում է, և դրա վերաբերյալ որոշումը կայացվելու է ընդամենը 4 օրում։ Այսօր հրավիրված ասուլիսի ժամանակ այս մասին հայտարարեց նրա պաշտպանական խմբի անդամ Արամ Վարդևանյանը։

Ինչպես հայտնի է, դեկտեմբերի 30-ին դատարանը փոխեց գործարարի խափանման միջոցը, և կալանքը փոխարինվեց գրավով և տնային կալանքով։ Նույն օրը նա ՔԿՀ–ից տեղափոխվեց տուն։

Արամ Վարդևանյանի խոսքով՝ հունվարի 12-ին Վերաքննիչ հակոկոռուպցիոն դատարանի դատավորը վարույթ է ընդունել հունվարի 5-ին առձեռն հրատապ կարգով մուտքագրված դատախազի բողոքը՝ Կարապետյանի խափանման միջոցի փոփոխության վերաբերյալ (դեկտեմբերի 30-ին Կարապետյանի խափանման միջոց կալանավորումը փոխարինվեց տնային կալանքով– խմբ․)։ Ըստ Վարդևանյանի՝ վերաքննիչ ատյանում գործերով հիմնական լուծումները լինում են գրավոր ընթացակարգով՝ 10-օրյա ժամկետում։
 
«Այդ 10 օրը միշտ է եղել։ Օրինակ, Սամվել Կարապետյանի գործով այդ 10-օրյա ժամկետի տրամաբանությունը Հակակոռուպցիոն դատարանը մշտապես պահպանել է։ Այս անգամ այդպես չէ․ դատավորը նախատեսել է, որ մինչև հունվարի 15-ը պետք է ներկայացնենք գրավոր դիրքորոշումներ, տվյալներ, իսկ հունվարի 16-ին պետք է հրապարակվի դատական ակտը։ Ո՞ւր է շտապում Վերաքննիչ հակակոռուպցիոն դատարանը, դատախազը՝ հասկացանք, երևի թե դատախազությունում այլ խափանման միջոցի վերաբերյալ պատկերացում չկա»,- հայտարարեց Վարդևանյանը։
Հիշեցնենք` հունիսի 17-ին Սամվել Կարապետյանի տանը խուզարկություն իրականացվեց այն բանից հետո, երբ նա հրապարակավ աջակցություն հայտնեց Հայ առաքելական եկեղեցուն՝ ընդգծելով, որ մի փոքրիկ խմբակ, մոռանալով հայոց պատմությունը, հայ եկեղեցու հազարավոր տարիների պատմությունը, հարձակվել է հայ եկեղեցու վրա, հայ ժողովրդի վրա: Կարապետյանը կալանավորվեց հունիսի 18-ին։
Կարապետյանին մեղադրանք առաջադրվեց ՔՕ 290 (հարկերը, տուրքերը կամ այլ վճարներ չվճարել), 296 (փողերի լվացում), 422 (իշխանությունը զավթելուն, տարածքային ամբողջականությունը խախտելուն, ինքնիշխանությունից հրաժարվելուն կամ սահմանադրական կարգը բռնի տապալելուն ուղղված հրապարակային կոչերը) հոդվածներով։

Հոկտեմբերի 13-ին հայտնի դարձավ, որ Սամվել Կարապետյանի մեղադրանքը փոփոխվել է, ավելացվել է Քրեական օրենսգրքի 296-րդ հոդվածի 3-րդ մասի 2-րդ և 3-րդ կետերով նախատեսված մեղադրանքը՝ իշխանական կամ ծառայողական լիազորությունները կամ դրանցով պայմանավորված ազդեցությունն օգտագործելով՝ առանձնապես խոշոր չափերով փողերի լվացում։
