Պարզապես որոշել են քրեական վարույթ չնախաձեռնել ու... վերջ. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Հոկտեմբերի 31-ին «ՀայաՔվե» քաղաքացիական-հասարակական միավորումը հանցագործության մասին հաղորդում էր ներկայացել Գլխավոր դատախազություն՝ Հոհաննավանքում Նիկոլ Փաշինյանի մասնակցությամբ ծես կազմակերպելու, ինչպես նաև իրավապահների անմիջական մասնակցությամբ և խոչընդոտող խմբերի ներգրավմամբ Հովհաննավանքը բռնազավթելու, տեղում ծառայության նշանակված քահանաների հոգևոր ծառայությունը խաթարելու և, ընդհանրապես, Հայաստանյաց առաքելական սուրբ եկեղեցու գործունեությունը խոչընդոտելու վերաբերյալ։

Ըստ միավորման ներկայացուցիչների, տեղի ունեցածն առերևույթ համապ ա տաս խ ա նում է ՀՀ Քրե ա կ ա ն օրենսգրքի 209 և 441 հոդվածներում նկարագրված հանցավոր արարքներին։

«Փաստ» թերթը դիմել է գլխավոր դատախազություն՝ խնդրելով տեղեկացնել, թե ինչ ընթացք է ստացել հաղորդումը: Ստացված պատասխանում նշվում է, որ «ՀՀ հակակոռուպցիոն կոմիտեում քրեական վարույթ չնախաձեռնելու որոշում է կայացվել, որը հաստատվել է դատախազի կողմից»: Ի դեպ, նշենք, որ հուլիսի 8-ին ևս «ՀայաՔվեն» հաղորդում էր ներկայացրել: Այն ժամանակ էլ դատախազությունից ստացել էինք գրեթե նույնական պատասխան՝ այն տարբերությամբ, որ նախորդ դեպքում գոնե նշել էին, թե ինչ հիմքով են որոշել քրեական վարույթ չնախաձեռնել (173-րդ հողվածի 2-րդ մաս), այս անգամ նույնիսկ դա հարկ չէին համարել նշել: Դե, ինչ կարևոր է հիմքը, կարևորը, որ այդպես են որոշել:

Դե, հասկանալի է, խոսքը ընդդիմադիրների մասին չէ, որոնց ամեն մի խոսքը դառնում է քրեական վարույթ նախաձեռնելու, նույնիսկ կալանավորելու հիմք: Ավելին, իրավապահները կարող են ֆեյսբուքյան գրառման համար 73-ամյա գյումրեցի տատիկի նկատմամբ քրեական վարույթ նախաձեռնել, իսկ, ահա, Նիկոլ Փաշինյանի պարագայում պարզապես այդպես են որոշել ու վերջ:
